Competing interpretations of recurrent, contemporaneous events :

Since the inception of the naxalite movement in Andhra Pradesh in 1969, 551police personnel were killed including one DIG, two S.Ps, five D.S.Ps; 16 Inspectors and 49 Sub-Inspectors.  2928 civilians were killed; public and private property worth hundred of crores of rupees was destroyed; the extremist groups indulged in mindless violence and committed brutal murders.  The naxal violence increased since 1991.  They deliberately ambush and attack police with sophisticated firearms and explosives.  In order to create terror the Maoists are also targeting functionaries of ruling political parties and killing them brutally - (counter affidavit of the Director General of Police in W.P.No. 15419/06 including Annexures 2 and 7)
... the State Executive for the first time started extra-legal killing which is popularly known as Encounter since 1968 and as on today in the name of alleged encounter the State has snatched away lives of about 4000 people during the last four decades - (written submissions dated 4.3.2008 of Mr. V.Raghunath, Advocate for APCLC, in W.P.Nos. 7906/2000, 14475/02 and 440/03) 
The lesson for the MHA (Ministry of Home Affairs) is thus clear: it should advise state governments that brutal repression is no answer to the Naxalite movement; that the Naxalite ideology must be fought politically; that Naxalite criminal actions must be dealt with under the existing criminal and human rights laws; and that Naxalite social base, which springs from exploitation, inequality and injustice must be countered by purposeful political and administrative action to implement the promises made in the Preamble and the Directive Principles of State Policy of the Constitution. Police repression is attractive and easy to adopt by a government armed to the teeth with paramilitary forces, equipment, firepower and mobility!  However, police repression only goes to strengthen the Maoist thesis on the class character of the Indian State.  It is counter-productive and helps to increase the mass base of the Naxalites, which arises out of the failure of the State to deliver the developmental goods as mandated by the Constitution -- Political Violence and the Police in India (1). Steven Pinker observes: The most important and underappreciated trend in the history of our species: is the decline of violence. Cruelty as popular entertainment, human sacrifice to indulge superstition, slavery as a labor-saving device, genocide for convenience, torture and mutilation as routine forms of punishment, execution for trivial crimes and misdemeanors, assassination as a means of political succession, pogroms as an outlet for frustration, and homicide as the major means of conflict resolution - all were unexceptional features of life for most of human history. Yet today they are statistically rare in the West, less common elsewhere than they used to be, and widely condemned when they do occur.
The conceptual shift in emphasis from a theory of deterrence to a theory of prevention influences and substrates actions that Governments take to control dangerous human behavior.  These range from preventive warfare; proactive crime prevention techniques including phone tapping, stings, informers and moles; surgical, psychiatric or chemical methods for preventing *ual predation; racial, religious, ethnic or other forms of profiling; prior restraint on dangerous or offensive speech; use of torture or other extraordinary measures towards gathering intelligence considered essential to prevent imminent acts of terrorism; as also targeted killings of terrorists (4).
Executive and even judicial sanctions against life and liberty, it is axiomatic, must be explicitly spelt out in legislative authority.  This is the essence of civilized and constitutional governance.  In the context of our constitutional scheme and qua Article 21, the State shall not deprive any person of life or liberty except in accordance with the procedure established by law.  Considered in the context of the several other fundamental values which substrate the Indian constitutional architecture, including those in Articles 14 and 19, it is beyond disputation that an executive agency of the State (including the police) is not authorized to deprive a person of his life without substantive legislative authority and in accordance with the procedure established by law.
This non-derogable constitutional value and the concomitant executive and governance obligation could be preserved only by eternal vigilance towards maintaining the sanctity of life and liberty, effectuated and operationalised by relentless pursuit and administering of the sanctions enjoined by law, against depredation of life and liberty, by the unlawful conduct of any person, agency or instrumentality.
In a rule of law society operating under a constitutional order, either deterrent or preemptive executive action against prohibited human conduct including terrorist acts must be pursued only within the matrix of legislatively spelt out substantive and procedural rules of engagement and sanction.  The executive, whether political or the professional has no legitimate authority to act in derogation, independent of or beyond the sanction of law.  This is the price civil society and all institutions of government willingly pay for a constitutional way of life.
               In this case, the Court is called upon to identify the balance between the right to life of presumptive serious offenders of law and order      and of the equilibrium of civil society; and the sovereign obligation of the State to maintain such law and order equilibrium, within the context of constitutional injunctions and legislative authority. Robert Jackson, J., recorded a profound observation on the principles that must substrate the balancing between liberty and authority. The jurist said:  The task of this Court to maintain a balance between liberty and authority is never done, because new conditions today upset the equilibriums of yesterday.  The seesaw between freedom and power makes up most of the history of governments,    which, as Bryce points out, on a long view consists of repeating a painful cycle from anarchy to tyranny and back again.  The Court's day-to-day task is to reject as false, claims in the name of civil liberty which, if granted, would paralyze or impair authority to defend existence of our society, and to reject as false, claims in the name of security which would undermine our freedoms and open the way to oppression.  These are the competing considerations involved in judging any measures which government may take to suppress or disadvantage its  opponents and critics. -- American Communications Association v. Douds(5).
Summary of the factual matrix of the cases on board: W.P.No. 15419 of 2006 is instituted by the Andhra Pradesh Civil Liberties Committee (for short 'the APCLC') for a direction to the concerned police to register a crime into the offence of killing of eight (8) Maoist naxalites in an alleged encounter that occurred on 23-07-2006 in the Nallamala Forest near Darboina Penta and Nekkanti Palutla villages of Yerragondapalem mandal, Prakasham District, by registering a case under Section 302 of the Indian Penal Code, 1860 (for short 'the IPC') against the police personnel who participated in the alleged encounter; to initiate proceedings for their prosecution; to call for all the records with regard to the crime registered on this encounter; and to pass such other order or orders as may be deemed fit and proper in the circumstances of the case.
        In view of our analyses and conclusions on issues Nos. 1 to 3 we hold and declare that the conclusions of the Full Bench majority in APCLC (6 supra) do not represent the correct legal position; that the earlier decisions of the Division Benches in Narayanaswamy, Kannabiran and Anasuya (135, 136&137 supra)  and the dissenting opinion in APLC are in conformity with the law as declared in this judgment;  and that it is not within the province of this court to declare the judgment of the Supreme Court in PUCL (8 supra) as not representing the correct legal position.
        The illustrations referred to in the Full Bench majority and the assumptions drawn therefrom are also with respect, erroneous.  Providing security and protection to the Parliament, the Council of Ministers, the Members of Parliament and others participating in the session in the Parliament is a legitimate function of the police and if the police resorted to firing at terrorists in order to save lives and property, that would surely constitute a legitimate exercise of the right of private defense, if the imminence, gravity and proportionality standards are satisfied.  The APCLC Full Bench majority's conclusion that since the terrorists did not intend to attack the police who fired on them, if a case were registered against police personnel for having caused the death of terrorists in the Parliament attack, they would be exposed to an almost certain conviction for the offence u/Sec. 302 IPC, is an assumption that is at clear variance with the law.  Illustrations by the Full Bench majority of an extremists killing in a village in the State or of arson of a passenger train by extremists' organization, are also non- sequitor, for reason alike.
        In PUCL (8 supra) in Manipur, a disturbed area with a considerable component of terrorists activity affecting public order and even the security of the State, two persons along with some others were seized by the police from a hut, taken a long distance away in a truck, and shot there.  The Apex Court (per B.P.Jeevan Reddy,J)  observed:  If the police had information that terrorists were gathering at a particular place and if they had surprised them and arrested them, the proper course for them was to deal with them according to law.
"Administrative liquidation" was certainly not a course open to them. (emphasis)         The PUCL observation above, represents the binding standard and with respect, wholly accords with the balancing standards (between liberty and authority), propounded by Robert Jackson, J in American Communications   Association (5 supra).
        In Prakash Singh and Ors vs Union of India and Ors (138) the Supreme Court issued directions to the Central and State Governments to comply with a set of seven directives that delineate practical measures to kick-start police reform. The 6th directive was to set up an independent Police Complaints Authority at the State and District level to look into the public complaints against police officer(s) in cases of serious misconduct including custodial death, grievous hurt or rape in police custody.  It is not known as to what is the State's response to this directive nor the extent of State's compliance with it.
        When human life is extinguished as a consequence of Executive action, review and accountability of the State action we consider, is a constitutional necessity.
The Report of the Independent Commission on Policing for Northern Ireland spells out the several aspects to accountability in policing.  According to this report:
 there is democratic accountability, by which the elected representatives of the community tell the police what sort of service they want from the police, and hold the police accountable for delivering it.  There is transparency, by which the community is kept informed, and can ask questions, about what the police are doing and why.  There is legal accountability, by which the police are held to account if they misuse their powers.  There is financial accountability, by which the police service is audited and held to account for its delivery of value for public money.  And there is internal accountability, by which officers are accountable within a police organization.
All of these aspects must be addressed if full accountability is to be achieved, and if policing is to be effective, efficient, fair and impartial (139).    Independent over-sight bodies to augment Government and internal accountability systems with external or non-police oversight mechanisms have been set up in several jurisdictions across Europe, Africa and Canada.  Such systems are to complement existing mechanisms and together to create a web of   accountability from which it could be increasingly difficult for police
misconduct to escape without consequences.  Example of such bodies are the   Independent Police Complaints Commission and the Police Integrity Commission,   New South Wales;  The Independent Complaints Directorate, South Africa; The  Police Ombudsman in Northern Ireland; the Independent Police Complaints  Commission established pursuant to the report of the inquiry by Lord Scarman and Stephen Laurence Inquiry, 1999.
Among the non-binding but international standards may be mentioned the United Nations 1979 Code of Conduct for Law Enforcement Officials; and the United  Nations Basic Principles on the Use of Force and Fire Arms by Law Enforcement Officials adopted by the 8th United Nations Congress on the Prevention of Crime and Treatment of Offenders (at Havana, Cuba, during 27th August to 7th September 1999).   The United Nations principles on the Effective Prevention and Investigation of extra-legal, arbitrary and summary executions, adopted on 24.05.1989 by the Economic and Social Council Resolution 1989/65 enumerate   potent (though non-binding) standards that list out the regime of investigative procedures to be followed.  In 1997 pursuant to the Vienna Declaration and Programme of Action, a set of Principles were drafted by the United Nations Commission on Human Rights to serve as guidelines to assist States in developing effective measures to combat impunity - The United Nations Principles for the Protection and Promotion of Human Rights through Action to Combat Impunity.
The Principles were refined in 2005 to reflect contemporaneous developments in International law and practices.  The principal goal of the raft of these principles is to provide for effective and enforceable remedies for the victim; and to uphold the public interest by deterring future violation.
        We have referred to the evolution, organizational correctives and establishment of independent over-sight bodies in certain other jurisdictions by way of illustrating the trajectory and the dynamics of vibrant Human Rights Jurisprudence.  The International conventions, best practices standards and principles are also referred to in the same context.
As pointed out by the Supreme Court in PUCL (8 supra) a Statute is to be interpreted and applied, as far as its language permits, so that it is in conformity and not in conflict with the established rules of International law.
Our analyses of the provisions of IPC and Cr.P.C. leads us to the inference that accountability for executive conduct resulting in death of civilian(s) is ensured by a rigorous investigation, the neutrality and professionalism of such investigation reinforced by statutorily embedded judicial oversight.  The relevant provisions of the IPC and Cr.P.C., the substantive and the procedural prescriptions of our criminal laws thus accord with the International Principles that mandate entrenchment of mechanisms for accountability of State actions that result in lethal consequences for civilians.
        Before we proceed to record the summary of our conclusions, on the issues framed, and analysed, we deal with an abstract submission urged on behalf of the State.  The learned Advocate General contended that the recurrent and regnant violence, the subversion of law and order and the challenge to the equilibrium of our civil society presented by Maoist/Naxalite activities constitute a grave crisis and challenge the sovereign authority of the State, legitimizing firm and resolute executive action.  Interpretation of our laws must therefore accommodate the pragmatic demand of appropriate executive response to this  crisis.
        We recognize that the limitations of human foresight guarantee the eventual failure of any constitutional or legislative arrangement as an ordering principle of political experience.  And insofar as emergencies expose those limits, they demonstrate the eventual contingency of all constitutional and legislated arrangements.  Senator John Potter Stockton remarked (we recall this observation as it is appropriate in the context): Constitutions are chains with which men bind themselves in their sane moments that they may not die by a  suicidal hand in the day of their frenzy.(140)  It is worth reflecting that when temptation does appear, typically in the guise of an emergency; we must ask whether our commitment to constitutional maintenance demands that we honor the   self-command expressed as limitations on governmental power in the constitutional and legal text, or surrender to the wish to be free of it.
        An apparent assumption in the State's argument, that our Constitution and the laws should accommodate all powers necessary to cope with the crises is that crises have beginnings and endings - that most crises are capable of resolution and that, upon their termination, the conditions and forms of constitutional government more or less return to normal.
        John E. Finn perceptively observes:  Few would be so foolhardy as to suggest that the workings of crisis government, particularly the flow of power to the executive, do not effect some permanent change in the ordinary patterns of constitutional government (141).   Edward S. Corwin explained that post-crisis government may so little resemble pre-crisis government that the difference might, as in the case of United States following World War II, or after the New Deal amount to a constitutional revolution.(142)         The rule of law culture is a wonderfully complex and rich theory of political organization.  Lord Bolingbroke made a classic statement on the meaning of constitutionalism.  He observed that constitutionalism is a form of government conducted by fixed principles of reason directed to certain fixed objects of public good.(143)   The fixed principles of reason bind since, Lord Bolingbroke, formulated - the community hath agreed to be bound by them.
        In a constitutional government there are substantive objectives (the fixed objects of public good), structural limitations, and procedural guarantees that limit the exercise of State power.  Indeed, the concept of limited power, of restraints upon not only the exercise but also the proper object of power, is central to any understanding of constitutionalism and of a rule of law regime within it. (144)
        We have considered it appropriate to resonate to the abstract State claims to crisis management; with observations on the normative principles of constitutionalism and rule of law fundamentals.  We say that core and critical social policy and governance choices, particularly involving rights to life and liberties must be expressed in legislative instruments. We need say no more.
        The learned Advocate General, Sri K.G.Kannabiran, Sri Uday Lalit, and Sri Bojja Tarakam - learned Senior Counsel; and the other learned counsel for the several parties in the batch of cases before us, have presented the respective positions on the several critical issues that we have considered in this judgment, in considerable forensic detail and with commendable and painstaking effort.  We record our gratitude to the learned counsel for the assistance rendered.  We particularly place on record our gratitude to Sri C. Padmanabha Reddy, the learned Senior Counsel who assisted this court with clinical analyses and his usual fairness on the several inter-meshing substantive and procedural provisions and the relevant precedents.
Summation :-
        To conclude, we hold:
(A) On issue No.1: That where a police officer causes death of a person, acting or purporting to act in discharge of official duties or in self-defense as the case may be, the first information relating to such circumstance (even when by a Police/Public Official; whether an alleged perpetrator is named or not) shall be recorded and registered as FIR, enumerating the relevant provisions of Law, (u/Sec. 154(1) Cr.P.C.) and shall be investigated (u/Sec. 156/157 Cr.P.C.).
(B) On issue No.2: That the existence of circumstances bringing a case within any of the Exceptions in the Indian Penal Code including the exercise of the right of private defense (a General Exception in Chapter IV IPC), cannot be conclusively determined during investigation.   The opinion recorded by the Investigating Officer in the final report forwarded to the Magistrate (u/Sec.173 Cr.P.C.), is only an opinion.  Such opinion shall be considered by the Magistrate in the context of the record of investigation together with the material and evidence collected during the course of investigation. The Magistrate (notwithstanding an opinion of the Investigating officer, that no cognizable offence appears to have been committed; that one or more or all of the accused are not culpable; or that the investigation discloses that the death of civilian(s) in a police encounter is not culpable in view of legitimate exercise by the police of the right of private defense), shall critically examine the entirety of the evidence collected during investigation to ascertain whether the opinion of the Investigating Officer is borne out by the record of investigation.  The Magistrate has the discretion to disregard the opinion and take cognizance of the offence u/Sec. 190 Cr.P.C.
(C) On issue No.3: That a magisterial enquiry (inquest) (u/Ss. 174 to 176 Cr.P.C.) is neither a substitute nor an alternative to the obligation to record the information as FIR and to conduct investigation into the facts and
circumstances of the case and if necessary to take measures for the discovery and arrest of the offender (s) (u/Ss. 154(1), 156 and 157 Cr.P.C.).  and
 (D) On issue No.4: In view of the conclusions on issues Nos. 1 to 3 and in view of our declaration [that the information conveyed to the officer in charge of a Police Station (u/Sec.154(1) Cr.P.C.) or a complaint made to the Magistrate (u/Chpt. XV Sec. 200 Cr.P.C.), need not mention the name of the Police Officer(s) who the complainant believes is the perpetrator of the offence complained of], it is not necessary to pronounce on whether the State, the Police Establishment or a Police Officer has immunity from the obligation to disclose the identity (of a police officer who had committed an act causing the death of a person), to a person aggrieved by such death to effectively seek justice. Whether the investigating officer is required to disclose the names of the police officers who are involved in an operation resulting in civilian casualty when a request for such information is lodged by an individual, is an issue not within the spectrum of the issues falling for our determination herein. This aspect is left open.  The obligation to disclose to the Investigating Officer the identity of the police officer(s) so involved, is however absolute and there is no immunity whatsoever from this obligation.
Withholding of any information or material that impedes effective or expeditious investigation violates several provisions of the Indian Penal Code and the Criminal Procedure Code (pointed out in our analyses on this issue).
        The reference is answered as above.  No order as to costs.

Code of Conduct for Law Enforcement Officials
Adopted by General Assembly of UNO resolution 34/169 of 17 December 1979
Article 1
Law enforcement officials shall at all times fulfill the duty imposed upon them by law, by serving the community and by protecting all persons against illegal acts, consistent with the high degree of responsibility required by their profession.
Commentary :
( a ) The term "law enforcement officials", includes all officers of the law, whether appointed or elected, who exercise police powers, especially the powers of arrest or detention.
( b ) In countries where police powers are exercised by military authorities, whether uniformed or not, or by State security forces, the definition of law enforcement officials shall be regarded as including officers of such services.
( c ) Service to the community is intended to include particularly the rendition of services of assistance to those members of the community who by reason of personal, economic, social or other emergencies are in need of immediate aid.
( d ) This provision is intended to cover not only all violent, predatory and harmful acts, but extends to the full range of prohibitions under penal statutes. It extends to conduct by persons not capable of incurring criminal liability.
Article 2
In the performance of their duty, law enforcement officials shall respect and protect human dignity and maintain and uphold the human rights of all persons.
Commentary :
( a ) The human rights in question are identified and protected by national and international law. Among the relevant international instruments are the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the United Nations Declaration on the Elimination of All Forms of Racial Discrimination, the International Convention on the Elimination of All Forms of Racial Discrimination, the International Convention on the Suppression and Punishment of the Crime of Apartheid , the Convention on the Prevention and Punishment of the Crime of Genocide, the Standard Minimum Rules for the Treatment of Prisoners and the Vienna Convention on Consular Relations.
( b ) National commentaries to this provision should indicate regional or national provisions identifying and protecting these rights.
Article 3
Law enforcement officials may use force only when strictly necessary and to the extent required for the performance of their duty.
Commentary :
( a ) This provision emphasizes that the use of force by law enforcement officials should be exceptional; while it implies that law enforcement officials may be authorized to use force as is
reasonably necessary under the circumstances for the prevention of crime or in effecting or assisting in the lawful arrest of offenders or suspected offenders, no force going beyond that may be used.

( b ) National law ordinarily restricts the use of force by law enforcement officials in accordance with a principle of proportionality. It is to be understood that such national principles of proportionality are to be respected in the interpretation of this provision. In no case should this provision be interpreted to authorize the use of force which is disproportionate to the legitimate objective to be achieved.
( c ) The use of firearms is considered an extreme measure. Every effort should be made to exclude the use of firearms, especially against children. In general, firearms should not be used except when a suspected offender offers armed resistance or otherwise jeopardizes the lives of others and less extreme measures are not sufficient to restrain or apprehend the suspected offender. In every instance in which a firearm is discharged, a report should be made promptly to the competent authorities.
Article 4
Matters of a confidential nature in the possession of law enforcement officials shall be kept confidential, unless the performance of duty or the needs of justice strictly require otherwise.
Commentary :
By the nature of their duties, law enforcement officials obtain information which may relate to private lives or be potentially harmful to the interests, and especially the reputation, of others. Great care should be exercised in safeguarding and using such information, which should be disclosed only in the performance of duty or to serve the needs of justice. Any disclosure of such information for other purposes is wholly improper.
Article 5
No law enforcement official may inflict, instigate or tolerate any act of torture or other cruel, inhuman or degrading treatment or punishment, nor may any law enforcement official invoke superior orders or exceptional circumstances such as a state of war or a threat of war, a threat to national security, internal political instability or any other public emergency as a justification of torture or other cruel, inhuman or degrading treatment or punishment.
Commentary :
( a ) This prohibition derives from the Declaration on the Protection of All Persons from Being
Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, adopted by the General Assembly, according to which:
"[Such an act is] an offence to human dignity and shall be condemned as a denial of the purposes of the Charter of the United Nations and as a violation of the human rights and fundamental freedoms proclaimed in the Universal Declaration of Human Rights [and other international human rights instruments]."
( b ) The Declaration defines torture as follows:
". . . torture means any act by which severe pain or suffering, whether physical or mental, is
intentionally inflicted by or at the instigation of a public official on a person for such purposes as obtaining from him or a third person information or confession, punishing him for an act he has committed or is suspected of having committed, or intimidating him or other persons. It does not include pain or suffering arising only from, inherent in or incidental to, lawful sanctions to the extent consistent with the Standard Minimum Rules for the Treatment of Prisoners."
( c ) The term "cruel, inhuman or degrading treatment or punishment" has not been defined by the General Assembly but should be interpreted so as to extend the widest possible protection against abuses, whether physical or mental.
Article 6

Law enforcement officials shall ensure the full protection of the health of persons in their custody and, in particular, shall take immediate action to secure medical attention whenever required.
Commentary :
( a ) "Medical attention", which refers to services rendered by any medical personnel, including
certified medical practitioners and paramedics, shall be secured when needed or requested.
( b ) While the medical personnel are likely to be attached to the law enforcement operation, law enforcement officials must take into account the judgement of such personnel when they recommend providing the person in custody with appropriate treatment through, or in consultation with, medical personnel from outside the law enforcement operation.
( c ) It is understood that law enforcement officials shall also secure medical attention for victims of violations of law or of accidents occurring in the course of violations of law.
Article 7
Law enforcement officials shall not commit any act of corruption. They shall also rigorously oppose and combat all such acts.
Commentary :
( a ) Any act of corruption, in the same way as any other abuse of authority, is incompatible with the profession of law enforcement officials. The law must be enforced fully with respect to any law enforcement official who commits an act of corruption, as Governments cannot expect to enforce the law among their citizens if they cannot, or will not, enforce the law against their own agents and within their agencies.
( b ) While the definition of corruption must be subject to national law, it should be understood to encompass the commission or omission of an act in the performance of or in connection with one's duties, in response to gifts, promises or incentives demanded or accepted, or the wrongful receipt of these once the act has been committed or omitted.
( c ) The expression "act of corruption" referred to above should be understood to encompass
attempted corruption.
Article 8
Law enforcement officials shall respect the law and the present Code. They shall also, to the best of their capability, prevent and rigorously oppose any violations of them.
Law enforcement officials who have reason to believe that a violation of the present Code has occurred or is about to occur shall report the matter to their superior authorities and, where necessary, to other appropriate authorities or organs vested with reviewing or remedial power.
Commentary :
( a ) This Code shall be observed whenever it has been incorporated into national legislation or
practice. If legislation or practice contains stricter provisions than those of the present Code, those stricter provisions shall be observed.
( b ) The article seeks to preserve the balance between the need for internal discipline of the agency on which public safety is largely dependent, on the one hand, and the need for dealing with violations of basic human rights, on the other. Law enforcement officials shall report violations within the chain of command and take other lawful action outside the chain of command only when no other remedies are available or effective. It is understood that law enforcement officials shall not suffer administrative or other penalties because they have reported that a violation of this Code has occurred or is about to occur.
( c ) The term "appropriate authorities or organs vested with reviewing or remedial power" refers to any authority or organ existing under national law, whether internal to the law enforcement agency or independent thereof, with statutory, customary or other power to review grievances and complaints arising out of violations within the purview of this Code.
( d ) In some countries, the mass media may be regarded as performing complaint review functions similar to those described in subparagraph ( c ) above. Law enforcement officials may, therefore, be justified if, as a last resort and in accordance with the laws and customs of their own countries and with the provisions of article 4 of the present Code, they bring violations to the attention of public opinion through the mass media.
( e ) Law enforcement officials who comply with the provisions of this Code deserve the respect, the full support and the co-operation of the community and of the law enforcement agency in which they serve, as well as the law enforcement profession.

PROTECTION OF HUMAN RIGHTS IN INDIA – AMENDMENT TO LAW
 You will be aware that the Human Rights Commissions of the Country (HRCs) have been complaining of lack of powers with them for proper discharge of duties to safeguard Human Rights as conceived in various International Conventions. Section 18 of the Protection of Human Rights Act, 1993  says as under :- 
Steps during and after inquiry
The Commission may take any of the following steps during or upon
the completion of an inquiry held under this Act, namely:-
(a) where the inquiry discloses the commission of violation of human rights or negligence in the prevention of violation of human rights or abetment thereof by a public servant, it may recommend to the concerned Government or authority –
(i)   to make payment of compensation or damages to the complainant or to the victim or the members of his family as the Commission may consider necessary;
(ii) to initiate proceedings for prosecution or such other suitable action as the Commission may deem fit against the concerned person or persons;
(iii) to take such further action as it may think fit;
(b) approach the Supreme Court or the High Court concerned for such directions, orders or writs as that Court may deem necessary;
(c) recommend to the concerned Government or authority at any stage of the inquiry for the grant of such immediate interim relief to the victim or the members of his family as the Commission may consider necessary;
(d) subject to the provisions of clause (e), provide a copy of the inquiry report to the petitioner or his representative;
(e) the Commission shall send a copy of its inquiry report together with its recommendations to the concerned Government or authority and the concerned Government or authority shall, within a period of one month,
or such further time as the Commission may allow, forward its comments on the report, including the action taken or proposed to be taken thereon, to the Commission;
(f) the Commission shall publish its inquiry report together with the comments of the concerned Government or authority, if any, and the action taken or proposed to be taken by the concerned Government or authority on the recommendations of the Commission.

It is very clear from the above text that the HRCs have only recommendatory powers under the Act thereby rendering the HRCs redundant and paper tigers only. They do not enjoy any power to issue directions or enforce their orders. The HRCs are ultimately dependent on State Machinery which is the main perpetrator i.e. infringing Human Rights. The Position is intolerable in a democratic Country governed by Rule of Law. The factual position is evidenced by the attachment which shows that recommendations  made during the year 2012-13 by West Bengal HRC has not only not been complied with but a large number of recommendations even not responded to by State Authorities as of now.  Commissions in the Country have been also constituted under other Acts like Consumer Protection Act, RTI Act etc. All these commissions have been conferred upon ample powers to impose costs, penalties and grant relief to the aggrieved parties.

The HUMAN RIGHTS COMMISSION OF SRI LANKA ACT, 1996 have the following provisions:-
11. For the purpose of discharging its functions the Commission may exercise any or all of the following powers:-
(a) investigate, any infringement or imminent infringement of fundamental rights in accordance with the succeeding provisions of this Act;
 (b) appoint such number of sum-committees at Provincial level, as it considers necessary to exercise such powers of the Commission as may be delegated to them, by the Commission, under this Act;
(c) intervene in any proceedings relating to the infringement or imminent infringement of fundamental rights, pending before any court, with the permission of such court;
(d) monitor the welfare of persons detained either by a judicial order or otherwise, by regular inspection of their places of detention, and to make such recommendations as may be necessary for improving their conditions of detention;
(e) take such steps as it may be directed to take by the Supreme Court, in respect of any matter referred to it by the Supreme Court;
(f) undertake research into, and promote awareness of, human rights, by conducting programs, seminars and workshops and to disseminate and distribute the results of such research;
(g) AWARD IN ITS ABSOLUTE DISCRETION TO AN AGGRIEVED PERSON OR A PERSON ACTING ON BEHALF OF AN AGGRIEVED PERSON, SUCH SUM OF MONEY AS IS SUFFICIENT TO MEET THE EXPENSES THAT MAY HAVE BEEN REASONABLY INCURRED BY HIM IN MAKING A COMPLAINT TO THE COMMISSION UNDER SECTION 14.
(h) do all such other things as are necessary or conducive to the discharge of its functions.

28. (1) Where a person is arrested or detained under the Prevention of Terrorism (Temporary Provisions) Act, No. 48 of 1979 or a regulation made under the Public Security ordinance, (Chapter 10) it shall be the duty of the person making such arrest or order of detention, as the case may be, to forthwith and in any case, not later than forty –eight hours from the time of such arrest or detention, inform the Commission of such
arrest or detention as the case may be and the place at which the person so arrested or detained is being held in custody or detention. Where a person so held in custody or detention is released or transferred to another place of detention, it shall be the duty of the person making the order for such release or transfer, as the case may be, to inform the Commission of such release or transfer, as the case may be, and in the case of a transfer, to inform the Commission of the location of the new place of detention.
(2) Any person authorized by the Commission in writing may enter at any time, any place of detention, police station, prison or any other place in which any person is detained by a judicial order or otherwise, and make such examinations therein or make such inquiries from any person found therein, as may be necessary to ascertain the condition of detention of the persons detained therein.
(3) Any person on whom a duty is imposed by subsection (1), and who willfully omits to inform the Commission as required by subsection (1), or who resists or obstructs an officer authorized under subsection (1) in the exercise by that officer of the powers conferred on him by that subsection, shall be guilty of an offence and shall on conviction after summery trial by a Magistrate, be liable to imprisonment for a period not exceeding one year or to a fine not exceeding five thousand rupees, or to both such fine and imprisonment.

Unfortunately the above beneficial provisions of Srilankan Act are absent from our Act. Therefore it is high time that similar provisions may be introduced in our Human Right law especially the section 18 (a) of the Act be reworded to read as under:

“(a) where the inquiry discloses the commission of violation of human rights or negligence in the prevention of violation of human rights or abetment thereof by a public servant, it may DIRECT AND recommend to the concerned Government or authority –“

I under stand the insertion of this small phrase may prove beneficial to the victims of violation of human Rights at large. It is also prayed for that this small amendment to the Act kindly be effected through an Ordinance at an early date.

[justify]ब्रिटिश साम्राज्य के व्यापक हितों को ध्यान में रखते हुए गवर्नर जनरल ने भारतीय  साक्ष्य अधिनियम 1872 बनाया था| यह स्वस्प्ष्ट है कि राज सिंहासन पर बैठे लोग ब्रिटिश साम्राज्य के प्रतिनिधि थे और उनका उद्देश्य कानून बनाकर जनता को न्याय सुनिश्चित करना नहीं बल्कि ब्रिटिश साम्राज्य का विस्तार करना और उसकी पकड को मजबूत बनाए रखना था| आज भी हमारे देश में यही न्यायप्रणाली-परिपाटी  प्रचलित है| आज भी देश के न्यायिक अधिकारी, अर्द्ध-पुलिस अधिकारी की तरह व्यवहार करते हैं और गिरफ्तारी का औचित्य ठहराने के लिए वे कहते हैं कि जहां अभियुक्त का न्यायिक प्रक्रिया से भागने का भय हो उसे गिरफ्तार करना उचित है किन्तु जो पुलिस उसे पहले गिरफ्तार कर सकती वह उसे बाद में भी तो ढूंढकर गिरफ्तार कर सकती है| इसी प्रकार न्यायाधीशों का यह भी कहना होता है कि जहां अभियुक्त द्वारा गवाहों या साक्ष्यों से छेड़छाड़ की संभावना हो तो उसकी गिरफ्तारी उचित है| दूसरी ओर राज्यों के पुलिस नियम यह कहते हैं कि अपराध का पता लगने पर पुलिस को तुरंत घटना स्थल पर जाना चाहिए और सम्बंधित दस्तावेजों को बरामद कर लेना चाहिए| ऐसी स्थिति में यदि पुलिस अपने कर्तव्यों का निर्वाह नहीं करे उसका दंड अभियुक्त को नहीं मिलना चाहिए क्योंकि संविधान के अनुसार प्रत्येक व्यक्ति तब तक निर्दोष है जब तक कि उसे उचित परीक्षण में दोषी नहीं ठहरा दिया जाता| ठीक उसी प्रकार जहां साक्ष्यों से छेड़छाड़ की संभावना हो वहां कलमबंद बयान करवाए जा सकते हैं|  किन्तु देश का तंत्र हार्दिक रूप से यह कभी  नहीं चाहता कि दोषी को दंड मिले, अपराधों पर नियंत्रण हो अपितु वे तो स्वयं शोषण करना चाहते हैं|  दूसरा, जहां तक साक्षियों या प्रलेखों के साथ छेड़छाड़ का प्रश्न है, अभियुक्त में हितबद्ध परिवारजन, मित्र आदि भी यह कार्य कर सकते हैं और यहाँ तक देखा गया है कि शक्तिशाली अभियुक्त होने परिवादी पर स्वयम पुलिस दबाव डालती है| तो फिर क्या प्रलेखों और साक्षियों के साथ छेड़छाड़ की संभावना के मद्देनजर इन लोगों को भी गिरफ्तार कर लिया जाए?   

तत्कालीन गवर्नर जनरल का स्थान आज के राष्ट्रपति के समकक्ष था और ये कानून जनता के चुने गए प्रतिनिधियों द्वारा बनाए गए नहीं बल्कि जनता पर थोपे गए एक तरफ़ा अनुबंध की प्रकृति के हैं| जिस प्रकार राष्ट्रपति द्वारा जारी कोई भी अध्यादेश संसद की पुष्टि के बिना मात्र 6 माह तक ही वैध है उसी सिद्धांत पर ये कानून मात्र 6 माह की सीमित अवधि के लिए लागू रहने चाहिए थे और देश की संसद को चाहिए था कि इन सबकी बारीबारी से समीक्षा करे कि क्या ये कानून जनतांत्रिक मूल्यों को प्रोत्साहित करते हैं|  खेद का विषय है कि आज स्वतंत्र भारत में भी उन्हीं कानूनों को ढोया जा रहा है और उनकी समसामयिक प्रासंगिकता पर देश के संकीर्ण सोचवाले जन प्रतिनिधि और न्यायविद कभी भी प्रश्न तक नहीं उठा रहे हैं| अभी हाल ही यशवंत सिन्हा ने राजस्थान पत्रिका को दिए एक साक्षात्कार में कहा है कि दंड संहिता के आधार पर तो अंग्रेज देश में सौ साल तक शासन कर गए किन्तु विद्वान् श्री सिन्हा यह भूल रहे हैं कि शासन करने और सफल प्रजातंत्र के कार्य में जमीन-आसमान  का अंतर होता है| शासन चलाने में जनता का हित-अहित नहीं देखा जाता बल्कि कुर्सी पर अपनी पकड़ मात्र मजबूत करनी होती है| इससे हमारे जन प्रतिनिधियों की दिवालिया और गुलाम मानसिकता का संकेत मिलता है|

सिद्धांतत: संविधान लागू होने के बाद देश के नागरिक ही इस प्रजातंत्र के स्वामी हैं और सभी सरकारी सेवक जनता के नौकर हैं किन्तु इन नौकरों को नागरिक आज भी रेत में रेंगनेवाले कीड़े-मकौड़े जैसे नजर आते हैं| इसी कूटनीति के सहारे ब्रिटेन ने लगभग पूरे विश्व पर शासन किया है और एक समय ऐसा था जब ब्रिटिश साम्राज्य में कभी भी सूर्यास्त नहीं होता था अर्थात उत्तर से दक्षिण व पूर्व से पश्चिम तक उनका साम्राज्य विस्तृत था| उनके साम्राज्य में यदि पूर्व में सूर्यास्त हो रहा होता तो पश्चिम में सूर्योदय होता था| यह बात अलग है कि द्वितीय विश्व युद्ध के बाद सम्पूर्ण विश्व स्तर पर ही स्वतंत्रता की मांग बलवती होने लगी तो उन्हें धीरे- धीरे सभी राष्ट्रों को मुक्त करना पड़ा जिसमें 1947 में संयोग से भारत की भी बारी आ गयी| किन्तु भारत की शासन प्रणाली में आज तक कोई परिवर्तन नहीं आया है क्योंकि आज भी 80 प्रतिशत से ज्यादा वही कानून लागू हैं जो ब्रिटिश सरकार ने अपने निहित स्वार्थों की पूर्ति के लिए बनाए थे| ये कानून जनतंत्र के दर्शन पर आधारित नहीं हैं और न ही हमारे सामाजिक ताने-बाने और मर्यादाओं से निकले हैं| प्रजातंत्र में कानून समाज के लिए बनाए जाते हैं जबकि राजतन्त्र में समाज कानून मानने के लिए बाध्य होता है| सभ्य समाज में कानून सामाजिक नियंत्रण का साधन है और यह आचरण की लक्ष्मण रेखा है| कानून का उद्देश्य प्रत्येक को उसका वाजिब हक़ देना है| जब भी समाज या व्यक्ति के विरुद्ध कोई अनुचित कार्य किया जाए तो कानून हरकत में आता है| राज्य का यह कर्तव्य है कि वह अपराधियों से समाज की रक्षा करे| इस प्रकार अपराधों को राज्य के विरुद्ध माना जाता है और राज्य द्वारा अभियोजक की नियुक्ति की जाती है|     

दूसरा, एक महत्वपूर्ण तथ्य यह भी है कि यदि यही कानून जनतंत्र के लिए उपयुक्त होते तो ब्रिटेन में यही मौलिक कानून – दंड संहिता, दंड प्रक्रिया संहिता, दीवानी प्रक्रिया संहिता और साक्ष्य कानून आज भी लागू होते| किन्तु ब्रिटेन में समस्याओं को अविलम्ब निराकरण किया जाता है और वहां इस बात की प्रतीक्षा नहीं की जाती कि चलती बस में दुष्कर्म होने के बाद कानून बनाया जाएगा| कानून निर्माण का उद्देश्य समग्र और व्यापक होता है तथा उसमें दूरदर्शिता होनी चाहिए व  उनमें विद्यमान धरातल स्तर की सभी परिस्थितियों का समावेश होना चाहिए| कानून मात्र आज की तात्कालिक समस्याओं का ही नहीं बल्कि संभावित भावी और आने वाली पीढ़ियों की चुनौतियों से निपटने को ध्यान में रखते हुए बनाए जाने चाहिए| इनमें  सभी पक्षकारों के हितों का ध्यान रखते हुए संतुलन के साथ दुरूपयोग की समस्या से निपटने की भी समुचित व्यवस्था होनी चाहिए| किसी भी कानून का दुरूपयोग पाए जाने पर बिना मांग किये दुरूपयोग से पीड़ित व्यक्ति को उचित और वास्तविक क्षतिपूर्ति और दुरुपयोगकर्ता को समुचित दंड ही न्याय व्यवस्था में वास्तविक सुधार और संतुलन ला सकता है|   

भारत के विधि आयोग ने हिरासती हिंसा विषय पर दी गयी अपनी 152 वीं रिपोर्ट दिनांक 26.08.1994 में यह चिंता व्यक्त की है कि इसकी जड़ साक्ष्य कानून की विसंगतिपूर्ण धारा 27 में निहित है| साक्ष्य कानून में यद्यपि यह प्रावधान है कि  हिरासत में किसी व्यक्ति द्वारा की गयी कबुलियत स्वीकार्य नहीं है| यह प्रावधान भारतीय संविधान के अनुच्छेद 20 के अनुरूप है किन्तु उक्त धारा में इससे विपरीत प्रावधान है कि यदि हिरासत में कोई व्यक्ति किसी बरामदगी से सम्बंधित कोई बयान देता है तो यह स्वीकार्य होगा | कूटनीतिक शब्दजाल से बनायी गयी इस धारा को चाहे देश के न्यायालय शब्दश: असंवैधानिक न ठहराते हों किन्तु यह मौलिक भावना और संविधान की आत्मा के विपरीत है|
पुलिस अधिकारी अपने अनुभव, ज्ञान, कौशल से इस बात को भलीभांति जानते हैं कि इस प्रावधान के उपयोग से वे अनुचित तरीकों का प्रयोग करके ऐसा बयान प्राप्त कर सकते हैं या बनावटी कथन गढ़ सकते हैं जो स्वयं अभियुक्त के विरुद्ध प्रभाव रखता हो| यह एक बड़ी अप्रिय स्थिति है कि इस धारा के प्रभाव से शरारत की जा सकती है और इसके बल पर कबुलियत की रचना की जा सकती है| यदि हमें ईमानदार कानून की अवधारणा को आगे बढ़ाना हो तो इस कानून में आमूलचूल परिवर्तन करना पडेगा| भारतीय न्याय प्रणाली का यह सिद्धांत रहा है कि चाहे हजार दोषी छूट जाएँ लेकिन एक भी निर्दोष को को दंड नहीं मिलना चाहिए जबकि यह धारा इस सुस्थापित सिद्धांत के ठीक विपरीत प्रभाव रखती है|  भारत यू एन ओ का सदस्य है और उसने उत्पीडन पर अंतर्राष्ट्रीय संधि पर हस्ताक्षर कर दिये हैं और यह संधि भारत सरकार पर कानूनी रूप से बाध्यकारी प्रभाव रखती है तथा साक्ष्य कानून की धारा 27 इस संधि के प्रावधानों के विपरीत होने के कारण भी अविलम्ब निरस्त की जानी चाहिए|

स्वयं सुप्रीम कोर्ट ने डी के बासु के प्रसिद्ध मामले में कहा है कि मानवाधिकारों का सबसे बड़ा उल्लंघन अनुसंधान में उस समय होता है जब पुलिस कबूलियत के लिए या साक्ष्य प्राप्त करने के लिए थर्ड डिग्री तरीकों का इस्तेमाल करती है| हिरासत में उत्पीडन और मृत्यु इस सीमा तक बढ़ गए हैं कि कानून के राज और आपराधिक न्याय प्रशासन की विश्वसनीयता दांव पर लग गयी है| विधि आयोग ने आगे भी अपनी रिपोर्ट संख्या 185 में इस प्रावधान पर प्रतिकूल दृष्टिकोण प्रस्तुत किया है| यद्यपि पुलिस के इन अत्याचारों को किसी भी कानून में कोई स्थान प्राप्त नहीं है और स्वयं सुप्रीम कोर्ट ने  रामफल कुंडू बनाम कमल शर्मा के मामले में कहा है कि कानून में यह सुनिश्चित है जब किसी कार्य के लिए कोई शक्ति दी जाती है तो वह ठीक उसी प्रकार प्रयोग की जानी चाहिए अन्यथा बिलकुल नहीं और अन्य तरीके आवश्यक रूप से निषिद्ध हैं|

यद्यपि पुलिस को हिरासत में अमानवीय कृत्य का सहारा लेने का कोई अधिकार नहीं है किन्तु उक्त धारा की आड़ में पुलिस वह सब कुछ कर रही है जिसकी करने की उन्हें कानून में कोई अनुमति नहीं है और पुलिस इसे अपना अधिकार मानती है| दूसरी ओर भारत में पशुओं पर निर्दयता के निवारण के लिए 1960 से ही कानून बना हुआ है किन्तु मनुष्य जाति पर निर्दयता के निवारण के लिए हमारी विधायिकाओं को कोई कानून बनाने के लिये आज तक फुरसत नहीं मिली है| यह भी सुस्थापित है कि कोई भी व्यक्ति किसी प्रेरणा या भय के बिना अपने विरुद्ध किसी भी तथ्य का रहस्योद्घाटन नहीं करेगा अत: पुलिस द्वारा अभियुक्त से प्राप्त की गयी सूचना मुश्किल से ही किसी बाहरी प्रभाव के बिना हो सकती है| सुप्रीम कोर्ट ने पंजाब राज्य बनाम बलबीर सिंह (1994 एआईआर 1872) में कहा है कि यदि अभिरक्षा में एक व्यक्ति से पूछताछ की जाती है तो उसे सर्वप्रथम स्पष्ट एवं असंदिग्ध शब्दों में बताया जाना चाहिए उसे चुप रहने का अधिकार है। जो इस विशेषाधिकार से अनभिज्ञ हो उन्हें यह चेतावनी प्रारम्भिक स्तर पर ही दी जानी चाहिए। ऐसी चेतावनी की अन्तर्निहित आवश्यकता पूछताछ के दबावयुक्त वातावरण पर काबू पाने के लिए है। किन्तु इन निर्देशों की अनुपालना किस प्रकार सुनिश्चित की जा रही है कहने की आवश्यकता नहीं है|


साक्ष्य कानून के उक्त प्रावधान से पुलिस को बनावटी कहानी गढ़ने और फर्जी साक्ष्य बनाने के लिए खुला अवसर उपलब्ध होता है| कुछ वर्ष पहले ऐसा ही एक दुखदायी मामला नछत्र सिंह का सामने आया जिसमें पंजाब पुलिस ने फर्जीतौर पर खून से रंगे हथियार, कपडे और गवाह खड़े करके 5 अभियुक्तों को एक ऐसे व्यक्ति की ह्त्या के जुर्म में सजा करवा दी जो जीवित था और कालान्तर में पंजाब उच्च न्यायालय में उपस्थित था| पुलिस की बाजीगरी की कहानी यहीं समाप्त नहीं होती अपितु अन्य भी ऐसे बहुत से मामले हैं जहां बिलकुल निर्दोष व्यक्ति को फंसाकर दोषी ठहरा दिया जाता है और तथाकथित रक्त से रंगे कपड़ों  आदि की जांच में पाया जाता है कि वह मानव खून ही नहीं था अपितु किसी जानवर का खून था अथवा लोहे के जंग के निशान थे| इसी प्रकार पुलिस (जो सामान उनके पास उचंती तौर पर जब्ती से पडा रहता है) अन्य मामलों में भी अवैध हथियार, चोरी आदि के सामान की फर्जी बरामदगी दिखाकर अपनी करामत दिखाती है, वाही वाही लूटती है और पदोन्नति और प्रतिवर्ष पदक भी पाती है| नछत्र सिंह के उक्त मामले में पाँचों अभियुक्तों को रिहा करते हुए उन्हें एक करोड़ रुपये का मुआवजा दिया गया किन्तु इस धारा के दुरुपयोग को रोकने के लिए न ही तो यह कोई स्वीकार्य उपाय है और स्वतंत्रता के अमूल्य अधिकार को देखते हुए किसी भी मौद्रिक क्षतिपूर्ति से वास्तव में हुई हानि की पूर्ति नहीं हो सकती| इस प्रकरण में एक अभियुक्त ने तो  सामाजिक बदनामी के कारण आत्म ह्त्या भी कर ली थी| पुलिस के अनुचित कृत्यों से मात्र एक व्यक्ति के जीवन का महत्वपूर्ण भाग ही नहीं अपितु सम्पूर्ण परिवार इस प्रकार बर्बाद हो जाता है, व्यक्ति आर्थिक रूप से जेरबार हो जाता है, परिवार छिन्नभिन्न हो जता है, उसका भविष्य अन्धकार में लीन  हो जाता है और दोष मुक्त होने के बावजूद भी यह झूठा कलंक उसका जीवन भर पीछा नहीं छोड़ता है| समाज में उसे अपमान की दृष्टि से देखा जाता है महज इस कारण की कि साक्ष्य कानून के उक्त प्रावधान ने पुलिस के क्रूर हाथों में इसका दुरूपयोग करने का हथियार उपलब्ध करवाया|
वर्तमान कानून में परीक्षण पूर्ण होने पर दंड प्रक्रिया संहिता की धारा 313 के अंतर्गत न्यायाधीश अभियुक्त से स्पष्टीकरण माँगता है और अभियुक्त अपना पक्ष रख सकता है किन्तु उसकी यह परीक्षा न तो शपथ पर होती है और न ही उसकी प्रतिपरीक्षा की जा सकती | अत: यह बयान सामान्य बयान की तरह नहीं पढ़ा जाता और न ही बयान की तरह मान्य होता है | एक अभियुक्त भी सक्षम साक्षी होता है और जहां वह बिलकुल निर्दोष हो वहां स्वयं को साक्षी के तौर पर प्रस्तुत कर अपनी निर्दोषिता सिद्ध कर सकता है| चूँकि साक्षी के तौर पर दिए गए उसके बयान पर प्रतिपरीक्षण हो सकता है अत; यह बयान मान्य है| किन्तु भारत में इस प्रावधान का उपयोग करने के उदाहरण ढूढने से भी मिलने मुश्किल हैं | 

दंड प्रक्रिया संहिता की धारा 161  के अंतर्गत पुलिस को दिए गए बयानों को धारा 162 में न्यायालयों में मान्यता नहीं दी गयी है| देश की विधायिका को भी इस बात का ज्ञान है कि पुलिस थानों में नागरिकों के साथ किस प्रकार अभद्र व्यवहार किया जाता है इस कारण धारा 161 के बयानों के प्रयोजनार्थ महिलाओं और बच्चों के बयान लेने के लिए उन्हें थानों में बुलाने पर 1973 की संहिता में प्रतिबन्ध लगाया गया है जोकि 1898 की अंग्रेजी संहिता में नहीं था| प्रश्न यह है कि जिस पुलिस से महिलाओं और बच्चों के साथ सद्व्यवहार की आशा नहीं है वह अन्य नागरिकों के साथ कैसे सद्व्यवहार कर सकती है या उन्हें पुलिस के दुर्व्यवहार को झेलने के लिए क्यों विवश किया जाए|  इलाहाबाद उच्च न्यायालय के न्यायाधीश आनंद नारायण मुल्ला ने पुलिस को देश का सबसे बड़ा अपराधी समूह बताया था और हाल ही तरनतारन (पंजाब) में एक महिला के साथ सरेआम मारपीट  के मामले में स्वयं सुप्रीम कोर्ट के न्यायाधीशों ने  टिपण्णी की थी कि पुलिस में सभी नियुक्तियां पैसे के दम पर होती हैं| सुप्रीम कोर्ट ने दिल्ली ज्युडीसियल  सर्विस के मामले में भी कहा है कि पुलिस अधिकारियों पर कोई कार्यवाही नहीं करने से यह संकेत मिलता है कि गुजरात राज्य में पुलिस हावी है अत; दोषी पुलिस कर्मियों पर कार्यवाही करने से प्रशासन हिचकिचाता है| कमोबेश यही स्थिति सम्पूर्ण भारत की है और इससे पुलिस की कार्यवाहियों की विश्वसनीयता का सहज अनुमान लगाया जा सकता है| 


महानगरों में फुटपाथों, रेलवे  आदि पर मजदूरी करनेवाले, कचरा बीनने वाले गरीब बच्चे इस धारा के दुरूपयोग के सबसे ज्यादा शिकार होते हैं| अत: इस धारा को अविलम्ब निरस्त करने की आवश्यकता है जबकि पुलिस और अभियोजन यह कुतर्क दे सकते हैं कि एक अभियुक्त को दण्डित करने के लिए यह एक कारगर उपाय है| किन्तु वास्तविक स्थिति भिन्न है| आस्ट्रेलिया के साक्ष्य कानून में इस प्रकार  का कोई प्रावधान नहीं है फिर भी वहां दोष सिद्धि की दर- मजिस्ट्रेट मामलों में 6.1 प्रतिशत और जिला न्यायालयों के मामलों में 8.2 प्रतिशत है वहीँ भारतीय विधि आयोग अपनी 197 वीं रिपोर्ट में भारत में मात्र 2 प्रतिशत दोषसिद्धि की दर पर चिंता व्यक्त कर चुका है| इस प्रकार पुलिस और अभियोजन की यह अवधारणा भी पूर्णत: निराधार और बेबुनियाद है| पुलिस को अब उत्पीडन आधारित अन्ग्रेजी कालीन तरीकों का परित्याग कर साक्ष्य और अनुसन्धान के आधुनिक एवं उन्नत तरीकों पर ध्यान केन्द्रित करना चाहिए| न्यायशास्त्र का यह भी सिद्धांत है कि साक्ष्यों को गिना नहीं अपितु उनकी गुणवता देखी जानी चाहिए| ऐसी स्थिति में पुलिस द्वारा इस प्रकार गढ़ी गयी साक्ष्यों का मूल्याङ्कन किया जाना चाहिए|  वर्तमान में 1872 का विद्यमान  भारतीय साक्ष्य कानून समयातीत हो गया है और यह समसामयिक चुनौतियों का सामना करने में विफल है|

भारत में कानून के राज का अभिप्राय
देश में जब तक अनियंत्रित भ्रष्टाचार और विलम्बकारी तन्त्र की गहरी जड़ों वाली उत्पीडनकारी आपराधिक न्याय प्रणाली जारी रहेगी तब तक यह  अपराध और क्रूरता से पीड़ित लोगों को न्यायदान से मना करती रहेगीI  आज भारत के प्रत्येक उच्च और शक्तिसंपन्न अपराधी को न्यायपालिका पर पूरा विश्वास है और वह पूरी तरह से आश्वस्त है कि शिकायतकर्ता को वह एक लंबे और शरारतपूर्ण मार्ग पर धकेलने में समर्थ है और इसमें अंतिम विजय उस अपराधी की ही होगी जहां लगातार देरी से व्यथित व्यक्ति के साथ गंभीर अन्याय होगा जिसमें औपनिवेशिक व्यवस्था द्वारा देरी से किया न्याय न्याय हेतु मनाही में बदल जायेगा|  जो लोग इस सुस्थापित व्यवस्था को चलाने के लिये प्रशिक्षित और सिद्धहस्त हैं उनसे इस संस्था में कोई चमत्कारिक या क्रांतिकारी बदलाव की अपेक्षा नहीं की जा सकती- ऐसे परिवर्तन जिनसे बिलकुल विपरीत परिणाम प्राप्त हो सकें|
लोकतंत्र की अपेक्षा है कि ब्रिटिश शासन से बाद भारत के लोगों को सुरक्षा और न्याय मिले| न्यायपालिका को यह भ्रम हो सकता है कि उसकी जनता में बड़ी इज्जत है जबकि आम भारतीय पर्याप्त लंबे समय से  दोनों ही संस्थानों- न्यायपालिका और पुलिस जो औपनिवेशिक व्यवस्था में शासन का अंग माना गया था से आतंकित और हताश है| सभ्य समाज की संवेदनहीनता के कारण आज दुर्घटना और हिंसक अपराधों के पीड़ित दम तोडते रहते हैं किन्तु इस कारण नहीं कि हम अमानवीय हैं परन्तु इस उत्पीडन कारी आपराधिक न्याय संस्थान – न्यायपालिका व पुलिस  के खोप के कारण| कानून में विश्वास करने वाले भारत के आम नागरिक न्यायपालिका और पुलिस की उस कार्य संस्कृति से पूरी तरह से भयभीत हैं जो उसे औपनिवेशिक युग से विरासत में प्राप्त हुई है| आज भी देश की न्यायपालिका लोकतान्त्रिक मूल्यों को नए ढंग से परिभाषित करने के स्थान पर औपनिवेशिक संस्था की तरह तात्कालीन प्रोटोकोल और परम्पराओं को  ही आगे बढ़ा रही है और करोड़ों भारतीयों को शासन का बड़पन और शक्ति अति भयभीत कर रहे हैं व आम आदमी को विवश कर संस्थागत न्यायिक विलम्ब के निर्बाध कुचक्र के माध्यम से उसका आर्थिक शोषण कर गंभीर अन्याय के वश में कर रही है तथा एक मात्र हानिकारक भ्रष्टाचार के कारण यह जारी है| औपनिवेशिक काले कानूनों और उनकी भाषा का जारी रहना करोड़ों भारतीयों के लिए आज भी एक  पहेली बना हुआ है और भारतीय समाज और समुदाय लोकतान्त्रिक मूल्यों के साथ टकराव जारी रखे हुए है| इन औपनिवेशिक काले कानूनों के माध्यम से किया जाने वाला तथाकथित न्याय हमारे सामाजिक तानेबाने से नहीं निकला है अपितु वह सत्रहवीं और अठारवीं सदी के यूरोप की उपज है जो कि कानून और न्याय के नाम पर बड़ी संख्या में मानवजाति को गुलाम बनाने की पश्चिमी सामाजिक तकनीक रही है| ये समस्त कानून देशी भारतीयों पर थोपे गए एक तरफा अनुबंध मात्र हैं जो जिम्मेदार लोगों को सुरक्षा प्रदान करने के सिद्धांत पर राज्य की स्थापना करते हों| भूत की तरह पुलिस की ओर से आनेवाली गोलियों को आज भी विशेष संरक्षण प्राप्त है| लोगों को ऐसी भाषा में न्याय नहीं दिया जा सकता जिसे वे जानते ही नहीं हों| इंग्लॅण्ड में इतालवी या हिंदी भाषा में न्याय देने का दुस्साहस नहीं किया जा सकता किन्तु भारत में 65 वर्षों से यह सब कुछ जारी है क्योंकि 2 फरवरी 1835 को थोमस बैबंगटन मैकाले ने इसे इजाद किया था कि हमें एक ऐसा वर्ग तैयार करने का भरसक प्रयास करना  है जो हमारे और जिन  करोड़ों भारतीयों पर हम शासन करें के बीच अनुवादक का कार्य कर सके – एक ऐसा वर्ग  जो रक्त और रंग से  तो भारतीय हो परन्तु विचारों, नैतिकता और रूचि से अंग्रेज हो| आज की भारतीय न्याय व्यवस्था ने मैकाले के स्वपनों को साकार करने के अतिरिक शायद ही कुछ किया होगा| आज की भारतीय न्याय प्रणाली भी काले उपनिवेशवादी कानूनों, प्रोटोकोल और परम्पराओं को जारी रखे हुए है जिनमें एक गरीब न्यायार्थी की स्थिति मात्र गुलाम जैसी होकर रह जाती है और अत्याचारी पुलिस, जो चाहे अत्याचार कर सकती हैं और निर्भीक  होकर हत्याएं कर सकती है, को एक सुरक्षा के आवरण में ढांक दिया जाता है व ऐसे मामलों में स्वतंत्र न्यायिक जांच के लिए मना करने वाली न्यायपालिका इन आपराधिक कृत्यों का उत्साहपूर्वक संरक्षण करती है| अफसोस कि फिर भी इसे न्याय, कानून के समक्ष समानता और लोकतंत्र  कहा जाता है| अब समय आ गया है जबकि आम भारतीय को सत्य की पहचान करनी चाहिए और इस उपनिवेशवादी मुकदमेबाजी उद्योग की चक्की में नहीं पीसना चाहिए और बदनामीयुक्त जीवन  में नहीं रहना चाहिए| स्वतंत्र भारत के सम्पूर्ण काल का जिक्र ही क्या करना जब मात्र 1990 से लेकर 2007 तक के बीच करीब 17000 हजार आरोपी व्यक्ति अर्थात पुलिस की अन्य ज्यादतियों और यातनाओं को छोड़कर भी प्रतिदिन औसतन 3 व्यक्ति पुलिस हिरासत  में मर चुके हैं और शायद ही इनमें से किसी पुलिसवाले का बाल भी बांका हुआ हो| यहाँ तक की प्रमाण स्वरूप घटना का वीडियो उपलब्ध हो तो भी पुलिस का कुछ नहीं बिगडता आखिर पुलिस अंग्रेजी शासनकाल से सर्वोच्च जो है| आज हमारी इस विकृत, और लोकतांत्रिक सिद्धांतों के विपरीत और अनुपयुक्त प्रणाली में तुरंत निम्न परिवर्तन करने की महती आवश्यकता है| उन समस्त उपनिवेशवादी काले कानूनों और परम्पराओं की पहचान कर निरस्त किया जाये जो  वर्ग भेद करते हैं व कानून में विश्वास करने वालों में भय उतपन्न करने वाली शक्ति और छवि का प्रदर्शन करते  हों और अपराधियों को प्रेरित करते हों| आज राष्ट्रद्रोह कानून को चंद लोगों की मर्जी पर नहीं छोड़ा जा सकता जो जनविरोधी उपनिवेशवादी कानून को अन्याय और भ्रष्टाचार  के विरुद्ध उठने वाले स्वरों को दबाने कुचलने लिए चुनिन्दा तौर पर इसका उपयोग करते हों| उन सभी उपनिवेशवादी कानून के अंतर्गत प्रसन्ज्ञान लिया जाना बंद होना चाहिए जिनका निर्माण मात्र शासक वर्ग द्वारा शोषण और अत्याचारों के विरुद्ध उठने वाले विरोधी स्वरों को दबाने के लिए किया गया हो – विशेषतया दंड प्रक्रिया संहिता की धारा 46, 129, 144, 197 आदि और वे सब विशेष कानून जो मुठीभर अपराधियों ने लोगों की स्वतन्त्रता और कानून के समक्ष समानता छीनने के लिए बनाये हों| एक लोकतान्त्रिक शासन प्रणाली में राज्य के आपराधिक कानून से किसी को भी विशेष सुरक्षा नहीं दी जा सकती और इससे समानांतर संवैधानिक व्यवस्था का जन्म होता है|

जिन बलों का गठन बाहरी आक्रमणों से रक्षा के लिए किया गया है उनका देश में प्रयोग नहीं होना चाहिए क्योंकि उन्हें मात्र बाहरी आक्रमणों से निपटने का प्रशिक्षण होता और उनका देश के नागरिकों के विरुद्ध उपयोग लोकतांत्रिक सिद्धांतों के सर्वथा विपरीत है| हमारे चुने गए जन प्रतिनिधियों को चाहिए कि वे अपने क्षेत्र की जनता से इन प्रस्तावित विधेयकों पर परामर्श लें क्योंकि जनता ने उहें अपना प्रतिनिधि चुनकर कोई गुनाह नहीं किया है –अपने सभी लोकतान्त्रिक अधिकार गिरवी नहीं रखे हैं| हमारी मान्यता है कि लोकतंत्र कोई मूकदर्शी खेल नहीं है बल्कि सतत रूप से कानून का राज है – ऐसे कानून का राज जो जमीनी स्तर के लोगों की सहभागिता वाले हमारे सामाजिक ताने बाने से बुना गया हो|

[justify]ब्रिटिश साम्राज्य के व्यापक हितों को ध्यान में रखते हुए गवर्नर जनरल ने भारतियों पर विभिन्न कानून थोपे थे| यह स्वस्प्ष्ट है कि भारत में राज्य पदों पर बैठे लोग तत्कालीन ब्रिटिश साम्राज्य के प्रतिनिधि थे और उनका मकसद कानून बनाकर जनता को न्याय सुनिश्चित करना नहीं बल्कि ब्रिटिश साम्राज्य का विस्तार करना, उसकी पकड को मजबूत बनाए रखना था और बदले में अच्छे वेतन-भत्ते, सुख-सुविधाएँ व वाही-वाही लूटना था| इसी कूटनीति के सहारे ब्रिटेन ने लगभग पूरे विश्व पर शासन स्थापित कर लिया था और एक समय ऐसा था जब ब्रिटिश साम्राज्य में कभी भी सूर्यास्त नहीं होता था अर्थात उत्तर से दक्षिण व पूर्व से पश्चिम तक उनका ही साम्राज्य दिखाई देता था| उनके साम्राज्य के पूर्वी भाग में यदि सूर्यास्त हो रहा होता तो पश्चिम में सूर्योदय हो रहा होता था| इसी क्रम में बेंजामिन फ्रेंक्लिन ने ब्रिटिश सम्राट व मंत्रियों को भी ब्रिटिश साम्राज्य के विस्तार हेतु कूटनीतिक मूल मन्त्र दिया था| बेंजामिन फ्रेंक्लिन ने ऐसा ही सुझाव देते हुए कहा था कि यदि प्रजाजन स्वतन्त्रता की मांग करें, परिवर्तनकारी विचारों का पोषण करें तो उन्हें दण्डित करें| वे चाहे कितना ही शांतिपूर्ण ढंग से जीवन यापन करें, शासन के प्रति अपना लगाव रखें, धैर्यपूर्वक आपके अत्याचारों को सहन करें तो भी उन्हें क्रांतिकारी ही समझें उनसे गोलियों और डंडे से निपटें और दबाये-कुचले रखें| यद्यपि शासन की शक्ति लोगों के विचारों पर निर्भर करती है किन्तु राजा की इच्छा को सर्वोपरि समझें| यदि आप अच्छे और बुद्धिमान लोगों को वहां गवर्नर बनाकर भेजेंगे तो वे समझेंगे कि उनका राजा अच्छा है और उनका भला चाहता है| यदि आप विद्वान और सही लोगों को वहां जज नियुक्त करोगे तो लोग समझेंगे कि राजा न्यायप्रिय है|इसलिए आप इन पदों पर नियुक्ति करने में सावधानी बरतें|
यदि आप कुछ हारे हुए जुआरियों, सटोरियों व फिजूलखर्ची लोगों को वहां गवर्नर बनकर भेजें तो वे इस पद के लिए बड़े उपयुक्त होंगे क्योंकि लोगों का शोषण कर वे उन्हें उद्वेलित करेंगे| झगडालू और अनावश्यक बहसबाजी  करने वाले वकीलों को भी न भूलें क्योंकि वे अपनी छोटी सी संसद में हमेशा विवाद खडा करते रहेंगे| अटोर्नी क्लर्क और नए वकील मुख्य न्यायाधीश के पद के लिए बड़े माफिक रहेंगे और वे आपके विचारों से प्रभावित रहेंगे| इन प्रभावों की पुष्टि और गहरे प्रभाव  के लिए, जब कभी भी कोई पीड़ित कुप्रबन्ध, उत्पीडन या अन्याय  की शिकायत लेकर आये तो ऐसे लोगों को भरपूर देरी, खर्चे से जेरबार कर और अंतत: पीड़ित करने वाले के पक्ष में निर्णय देकर शिकायतकर्ता को ही दण्डित करें| ऐसा करने का यह सुप्रभाव होगा कि भविष्य में होने वाली शिकायतों और मुकदमों पर स्वत: अंकुश लगेगा तथा स्वयम गवर्नर और जज, अन्याय व उत्पीडन करने के लिए आगे और प्रेरित होंगे जिससे लोग हताश होंगे| जब ऐसे गवर्नर यह महसूस करने लगें कि वे लोगों के बीच सुरक्षित नहीं रह सकते तो उन्हें वापिस बुला लिया जाये और उन्हें पेंशन से नवाजें | इससे नए गवर्नर भी यही मार्ग अपनाने को प्रेरित होंगे और सर्वोच्च सरकार को स्थायित्व प्रदान करेंगे|
जनता पर नए नए कर लगायें| जब जनता अपनी संसद को शिकायत करें कि उन पर ऐसी संस्था कर लगा रही है जहां उनका कोई प्रतिनिधित्व ही नहीं है और यह सामान्य अधिकारों के विपरीत है| वे अपनी शिकायतों के निवारण के लिए प्रार्थना करेंगे |संसद को उनके दावों को ख़ारिज करने दें और यहाँ तक कि उनकी प्रार्थनाओं को पढने से ही मना कर दें, और प्रार्थियों के साथ उल्लंघनकारी की तरह बर्ताव करें| इस सब को सुकर बनाने के लिए ऐसे जटिल और अंतहीन कानून बनायें कि उनकी पालना और याद रखना असंभव हो| जनता की प्रत्येक विफलता के लिए उनकी सम्पति जब्त करें| ऐसी सम्पति के दावों के मुकदमों को जूरी से वापिस लेलें और इसे ऐसे मनमाने जजों को सौंपें जिन्हें आपने नियुक्त किया हो तथा जो देश में निकृष्टतम चरित्र वाले हो व जिनके वेतन भत्ते इस सम्पति की कीमत से जुड़े हों व उनका कार्यकाल आपकी कृपा पर निर्भर हो|
बेंजामिन ने आगे यह परामर्श दिया कि तब यह भी घोषणा कर दें कि आपके आदेशों की अवहेलना देशद्रोह होगा और ऐसा करनेवाले संदिग्ध लोगों को पकड़कर सम्राट के न्यायालय में सुनवाई के लिए लन्दन भेज दें| सेना का एक नया न्यायालय बना दें जिसे निर्देश हों कि ऐसे लोग यदि अपनी निर्दोषिता की कोई गवाही देना चाहें तो उन्हें खर्चे से बर्बाद कर दें और यदि वे ऐसा न कर सकें तो उन्हें फांसी पर लटका दें| ऐसा करने से लोगों को यह विश्वास हो जाएगा कि यह कोई ऐसी शक्ति है जिसका धर्म ग्रंथों में उल्लेख हो जो न केवल उनके शरीर बल्कि उनकी आत्मा को ही मार देगी| लोगों पर कर लगाने के लिए, जहां तक संभव हो सबसे घटिया दर्जे के उपलब्ध निकृष्टतम लोगों का बोर्ड बनाकर भेजें| इन लोगों के वेतन-भत्ते, सुख-सुविधाएँ मेहनतकश जनता के खून पसीने  की कमाई के शोषण से उपजते हों क्योंकि राजा ने कोई खर्चा नहीं देना है | ऐसे  लोगों के सभी वेतन-भत्ते, सुख सुविधाओं पर कोई कर न लगे और इनकी सम्पति कानूनन सुरक्षित रहे| यदि किसी राजस्व अधिकारी पर जनता के प्रति नरमी का ज़रा भी संदेह हो तो उसे तुरंत निकाल फेंके| यदि अन्य राजस्व अधिकारियों के विरूद्ध कोई जायज शिकायत भी हो तो उसका संरक्षण करें| सबसे अच्छा तो यह रहेगा कि कि लोग असंतुष्ट रहें, उनका सम्मान-मनोबल घटे और उनमें पारस्परिक लगाव-प्रेम घटता जाए जिससे आपके लिए शासन करना आसान हो जाएगा|

आज भी भारत में एक सेवानिवृत न्यायाधीश का चित्र गलती से मीडिया द्वारा दिखा दिए जाने से मानहानि की कीमत 100 करोड़ रुपये आंकी जाती है किन्तु हिरासत में मरने वाले व्यक्ति के सम्पूर्ण जीवन का मूल्य ही 2 लाख रूपये आंककर न्यायिक कर्तव्य की बलि दे दी जाती है, वहीं हम कानून का राज होने और स्वतन्त्रता का झूठा दम भरते हैं जबकि समाजवाद व न्याय का सिद्धांत कहता है जिसे जीवन में कम मिला हो उसे कानून में अधिक मिलना चाहिए| क्या हमारे जज और वकील  इसे याद नहीं रख पाते हैं या कुछ अन्य गोपनीय कारण कार्य कर रहे हैं|  भारत की वर्तमान शासन व न्याय व्यवस्था भी हमें अंग्रेजी शासन से विरासत में मिली हुई है और उसका हमने आज तक प्रजातांत्रिकीकरण नहीं किया है- जजों को देवतुल्य मान लिया है- बल्कि पोषण कर इसे आगे बढाया है| अब विद्वान् पाठक स्वतंत्र चिन्तन और मूल्याङ्कन करें कि हमारी विद्यमान व्यवस्था में क्या बेंजामिन द्वारा सुझाई गयी उक्त व्यवस्था से कोई भिन्नता है`, और हमें इसमें कैसे परिवर्तन करने की आवश्यकता है जिससे वास्तविक अर्थों में लोकतंत्र स्थापित हो सके|  [/justify]

[justify]प्राय: अखबारों की सुर्ख़ियों में ख़बरें रहती हैं कि अमुक अपराध में पुलिस ने ऍफ़ आई आर नहीं लिखी  और अपराधियों को बचाया है| पुलिस का कहना होता है कि लोग व्यक्तिगत रंजिशवश झूठी ऍफ़ आई आर लिखवाते हैं और इससे उनके इलाके में अपराध के आंकड़े अनावश्यक ही बढ़ जाते हैं जिससे उनकी रिपोर्ट खराब होती है और कई बार तो विधान-सभाओं तक में सवाल-जवाब होते हैं| इस कारण चुनिन्दा मामलों में (सभी में नहीं) पुलिस बहाना बनाती है कि वे मामले की पहले जांच करके ही रिपोर्ट लिखेगी| आम नागरिक के मन में यह धारणा गहरी बैठ जाती है कि पुलिस निक्कमी और भ्रष्ट है अत: कानून की पालना नहीं करती व जनता की रक्षा नहीं करती| किन्तु वास्तविक स्थिति क्या है यह तो गहराई में जाकर शासन के विभिन्न अंगों का चरित्र-पुराण खंगालने से ही पता लगेगा कि इस महान भारत भूमि पर कौन भ्रष्ट व निक्कमा नहीं | 

सर्वप्रथम उच्चतम न्यायालय को ही परखते हैं जिसने इफ आई आर के विषय में विभिन्न विरोधाभासी निर्णय देकर पुलिस को ऍफ़ आई आर लिखने से मना करने के लिए बल प्रदान किया है| कहानी मात्र यहीं पूर्ण नहीं होती अपितु उच्चतम न्यायालय ने अपने कार्यकरण के विषय में “ऐ हैण्ड बुक ऑफ़ इनफोर्मेसन” नामक एक पुस्तिका जारी की है जिसके पृष्ट 52 पर यह उल्लेख है कि ऍफ़ आई आर से मनाही के शिकायती पत्र को लेटर पिटीशन मानकर रिट दर्ज की जावेगी किन्तु वास्तव में उच्चतम न्यायालय में इस परिधि में आने वाले पत्रों को भी रिट की तरह दर्ज नहीं किया जाता है अपितु डाकघर की भांति ऐसी शिकायत को उसी आरोपित पुलिस अधिकारी को अग्रेषित मात्र कर अपने कर्तव्य की इतिश्री कर दी जाती है| जबकि ऐसा कोई प्रावधान इस पुस्तिका में नहीं है| यह मात्र साधारण मामलों में ही नहीं अपितु भ्रष्टाचार के गंभीर मामलों में भी होता है जिसे देखकर कई बार यह  लगता है कि देश में न्याय और कानून तो एक सपना मात्र है और देश की न्याय व्यवस्था बेरोजगारी दूर करने के लिए संचालित एक विशुद्ध वाणिज्यिक उपक्रम है| अब निचले स्तर पर कोई मजिस्ट्रेट यदि उच्चतम न्यायालय का अनुसरण  करते हुए कानून का उल्लंघन कर यही सुगम मार्ग अपनाए तो उसे दोष किस प्रकार दिया जा सकता है|
हमारी न्याय प्रणाली मूलत: इंग्लॅण्ड की व्यवस्था पर आधारित है किन्तु हमने  इसे समसामयिक नहीं बनाया है और देश की जनता को गलत पाठ पढ़ाया जा रहा है कि न्यायपालिका सर्वोच्च है| इसके विपरीत इंग्लॅण्ड में “न्यायिक पुनरीक्षा आयोग” कार्यरत है जो किसी भी न्यायालय में विचाराधीन अथवा निर्णित मामले में हस्तक्षेप कर सकता है और अन्याय होने का उसे विश्वास होने पर उचित राहत भी दे सकता है|  ऐसी व्यवस्था भारत में भी लागू की जा सकती है, विशेषकर तब जब न्यायपालिका को संदेह की दृष्टि से देखा जा रहा हो| अभी हाल ही में यह कहा गया है कि तेजाब के लिए लाइसेंस लागू कर दिया जाये किन्तु लाइसेंस तो हथियारों और विस्फोटकों के लिए भी आवश्यक  है, क्या इससे रक्तपात रुक गया है अथवा स्वयं पुलिस और सेना ये वस्तुएं अपराधियों को उपलब्ध नहीं करवा रही हैं| वास्तव में भारत में कड़े कानून बनाने का अर्थ भ्रष्ट लोकसेवकों की अपराधियों के साथ मोलभाव की शक्ति को बढ़ाना मात्र है, किसी अपराध पर नियंत्रण करना नहीं है| 

संविधान के अनुच्छेद 350 में जनता को अपने चुने गए प्रतिनिधियों और विधायिकाओं को अपनी व्यथा निवेदन करने का अधिकार है और यह अपेक्षित है कि जनप्रतिनिधि इन व्यथाओं पर गुणदोष के आधार पर निर्णय लें| जब जन प्रतिनिधि प्रश्न पूछने के लिए ही धन लेते हों तो फिर बिना धनवाली (अर्थहीन) जनव्यथा को सदन में उठाने की उनसे अपेक्षा नहीं की जा सकती| विधायिकाओं की स्थिति में इन व्यथाओं पर निर्णय का अधिकार अध्यक्ष को दिया गया है किन्तु इन व्यथाओं को विधायिकाओं में याचिकाओं के रूप में विधिवत दर्ज किये बिना निचले स्तर पर सचिव ही निरस्त कर देते हैं और इसी प्रकार मंत्रालयों में भी सम्बन्धित मंत्री के ध्यान में लाये बिना नीतिगत मामलों की जन परिवेदनाओं को भी रोजमर्रा के मामले की तरह सचिवों द्वारा ही निरस्त कर दिया जाता है|  इससे यह झूठी रंगीन छवि प्रस्तुत की जाती है कि मंत्रालय में कोई परिवेदना बकाया नहीं है अथवा शीघ्र निस्तारण कर दिया जाता है| इस प्रकार हमारा लोकतंत्र एक खाली डिब्बा-दिखावे से अधिक कुछ नहीं है| जब किसी मामले पर जनता उद्वेलित होती है तो तुष्टिकरण की कूटनीति अपनाते हुए किसी कमिटी या आयोग का गठन कर दिया जता है और उसके द्वारा प्रस्तुत रिपोर्ट कालान्तर में कूड़ेदान की शोभा बढ़ाती है| देश का अकेला विधि आयोग ही वर्ष में औसतन 4 रिपोर्टें दे रहा है और सरकार को एक रिपोर्ट पर कार्यवाही करने में औसतन 10 वर्ष लगे रहें हैं| इसी दर से अब तक प्रस्तुत 250 रिपोर्टों पर अगले 2500 वर्षों में कार्यवाही हो पाएगी और तब तक परिस्थितियाँ और परिदृश्य ही बदल चुका होगा तथा वे सभी रिपोर्टें अप्रासंगिक रह जाएँगी| यह हमारे लोकतंत्र की गति और प्रगति (अथवा दुर्गति) है जिसमें जब तक प्रत्येक लोक सेवक की स्पष्ट जिम्मेदारी तय करनेवाला कानून लागू नहीं होगा, संविधान सहित सभी अन्य कानून मात्र कागजी ही रहेंगे और जनता इस भूल-भूलैया में चक्कर खाती रहेगी |   

अभी सूचना का अधिकार अधिनियम के विषय में भी सरकार बड़ी वाही-वाही लूटने का प्रयास कर रही है और कुछ अपरिपक्व बुद्धिवाले नागरिक भी इस कानून को एक मील के पत्थर के रूप में महिमा मंडित कर रहे हैं| यह सही है कि इस अधिनियम के बाद सरकारी मशीनरी ने कागजों को संभालना शुरू कर दिया है किन्तु इससे अधिक कुछ नहीं हुआ है| लगभग एक हजार आवेदन के बाद मेरा विचार है कि आम नागरिक को मात्र पंद्रह प्रतिशत मामलों में ही वांछित सूचनाएं मिलती हैं और शेष मामलों में कोई सूचना नहीं मिलती चाहे किसी स्तर पर अपील दाखिल कर दें| प्रभावशाली लोग तो वैध या अवैध ढंग से पहले भी सूचनाएं लेते रहे हैं व आज भी ले रहे हैं| अधिनियम के प्रभाव से नागरिकों को कागज तो खूब मिलते हैं पर उनमें उपयोगी सूचनाएं अधिक नहीं होती हैं| अधिनियम में तीस दिन में सूचना देने की कल्पना की गयी थी किन्तु सूचना नहीं देने पर कई महीनों तक आयोगों में मामले दर्ज ही नहीं किये जाते हैं और निर्णय आने में वर्षों लग जाते हैं| पुलिस थानों की ही भांति सूचना आयोगों का भी विचार है कि मामले तुरंत दर्ज करने पर उनके पास बकाया का अम्बार दिखाई देगा अत: मामलों को दर्ज नहीं करके आयोग की झूठी सुन्दर और लोकलुभावन छवि पेश की जाये कि आयोग में बहुत कम मामले बकाया हैं और आयोग दक्षता पूर्वक कार्य कर रहा है| अब विद्वान् पाठकगण स्वयं निर्णय करें कि देश में विधायिका, न्यायपालिका अथवा कार्यपालिका में से कौनसा ऐसा तंत्र है जो मनमर्जी नहीं कर रहा अर्थात पुलिस थाने की तरह व्यवहार नहीं कर रहा है| मेरे विचार से तो सभी शक्तिसंपन्न लोग लोकतंत्र रुपी द्रोपदी का चीर हरने के लिए आतुर हैं|

STRIKE BY ADVOCATES 
Hon’ble Supreme Court of India has time and again emphasised (In Common Cause case & Ex-Capt. Harish Uppal v. Union of India) that the advocates have no right to strike work therefore any strike called by advocates is illegal. This practice should be dealt with heavy hand in the interest of justice. But this verdict of Hon’ble Court remains on papers only, and advocates are on strike on almost all days in this or that part of Country. Courts are very soft hearted  to striking advocates and put  a rubber stamp on Order sheet of the day, “advocates are on strike put up on…” , and the empty ritual of hearing be performed on this day. Such Courts are thus compounding the illegality and misconduct of advocates in this way.

If the advocates are defiant to Supreme Court orders regarding their conduct in courts, should they be allowed to appear in sub-ordinate courts still remains a “YAKSH” question. If the courts are unwilling to curb the indiscipinedness amongst advocates and correct them, have they any moral right to punish Executives, Police and ordinary citizens? The judges should conduct introspection on the points and fix a policy for them and exercise impartiality and neutrality.

Though some of the judges have shown firmness in the matter but advocates boycott such judges collectively. Are judges helpless against the might of arbitrariness, illegality and misconducts of advocates? The judges should collect courage to take stern action in the matter to curb the protracted malice, and should not succumb to pressure from any quarter. Whenever advocates proceed on strike, the judges may adjourn the case for a week for appearance affording a further opportunity and may order “advocates are on strike, put up on … for appearance of advocate with undertaking not to indulge in strike further.” And if the striking advocates still turn defiant then the case should be dismissed or decided on such date fixed for hearing on the strength of material as the case may be. No further application for restoration or Review from such advocates should be entertained without his undertaking to not to indulge in strike further. Judges may further refer the cases to Bar Council for disciplinary action against the delinquent advocates.
In view of the above, you are therefore; requested to kindly foil the attempts to strike the court work, cause prepared the list of advocates preventing the litigants to enter into the Courts Premises and inflict Contempt Proceedings in the rightful execution of the said verdict of the Hon’ble court.
