[justify]न्यायालयों में सुनवाई के सार का  सही एवं विश्वसनीय रिकार्ड ,फाइलिंग एवं सक्रिय सहभागिता  एक सशक्त , पारदर्शी  और विश्वसनीय न्यायपालिका की कुंजी है | 1960 के दशक से ही पश्चिमी यूरोप और उत्तरी अमेरिका के विकसित देशों में आंतरिक रिकोर्ड रखरखाव की प्रक्रिया की प्रभावशीलता में सुधार के लिए मांग उठी| सामान्यतया अधिक लागत वाली श्रम प्रधान (हाथ से संपन्न होने वाली) प्रक्रिया की तुलना में स्वचालित रिकार्ड करने और स्टेनोग्राफी के उपकरणों की ओर परिवर्तन को उत्तरी अमेरिका और पश्चिमी यूरोप के बाहर एक चुनौती के रूप में देखा जाता है| विकसित राष्ट्रों में  न्यायालयों को सशक्त सूचना संचार तकनीक ढांचे और कुशलता का लाभ मिलता है जिससे रोजमर्रा की कार्यवाहियों का ऑडियो वीडियो रिकार्ड, स्टेनो मशीन और बहुत से अन्य कार्य कंप्यूटर प्रणालियाँ के माध्यम से करना अनुमत है |

विकासशील और संघर्षरत राष्ट्रों में तकनीकि ढांचे का सामान्यतया अभाव है| इसलिए स्वस्थ न्यायिक तंत्र के निर्माण या पुनर्निर्माण में अन्तर्वलित महत्वपूर्ण कानूनी मुद्दों के अतिरिक्त विकासशील और संघर्षरत राष्ट्रों को न्यायसदन में रिकार्डिंग प्रणाली में सुधारों को प्रभावी बनाने हेतु तकनीकि ढांचे में भी सुधार करने चाहिए| आज अमेरिकी राज्यों सहित नाइजीरिया, बुल्गारिया, कजाखस्तान और थाईलैंड में मशीनीकरण पर भूतकालीन और चालू अनुभव  के आधार पर अध्ययन करने वाले निकाय हैं| मशीनीकृत रिकार्डिंग प्रणाली वाले न्यायसदन स्थापित करने और विकसित करने का ज्ञान रखने  वाले  निकाय दिनों दिन बढ़ रहे हैं| इन अध्ययनों में पश्चिमी विकसित  और विकासशील -दोनों- देशों में कुशल न्यायसदन रिकार्डिंग प्रणालियाँ स्थापित करने में चुनौतियाँ उभरकर सामने आई हैं | इन अध्ययनों में विकासशील राष्ट्रों की न्यायसदन में हाथ से  रिकार्डिंग की प्रणाली से अधिक दक्ष स्वचालित रिकार्डिंग प्रणाली की ओर परिवर्तन में सहायता करने के महत्त्व की ओर ध्यान आकर्षित किया गया है और इससे होने वाले लाभों की सूची भी दी गयी है|

विकसित, विकासशील और संघर्षरत राष्ट्रों में इस उच्च तकनीकि परिवर्तन में कई चुनौतियों का सामना करना पड़ा है जैसे – लागत में वृद्धि, सामान्य कानून एवं सिविल कानून में साक्ष्य रिकार्डिंग के भिन्न –भिन्न मानक, उपकरणों के उपयोग के लिए प्रारंभिक एवं उतरवर्ती प्रशिक्षण, सुविधाओं का अभाव और मशीनीकरण के कारण बेरोजगारी| उच्च तकनीकि रिकार्डिंग प्रणालियाँ स्थापित करने के लिए राजनैतिक इच्छाशक्ति के साथ साथ पर्याप्त वितीय संसाधनों की आवश्यकता है| दूसरे राष्ट्र  ऊँची लगत वाली उन्नत रिकार्डिंग मशीनों की लागत वसूली के लिए संघर्ष करते रहते हैं| अमेरिका में मेरीलैंड राज्य में और कजाखिस्तान गणतंत्र में  राजनैतिक इच्छाशक्ति और  वितीय संसाधन दोनों ही विद्यमान थे तथा वहाँ परंपरागत रिकार्डिंग प्रणाली से नई उन्नत तकनीक की ओर  परिवर्तन सफल रहा |
मेरीलैंड के अध्ययन से प्रदर्शित होता है कि नई रिकार्डिंग मशीन प्रणाली लगाने की एकमुश्त लागत प्रतिपूर्ति करने वाले दीर्घकालीन लाभों- वेतन भत्तों में कमी  आदि - को देखते हुए न्यायोचित है| अन्यथा एकमुश्त लागत एक चुनौती ही रहती है| कजाखिस्तान जैसे कई राष्ट्रों ने वितीय चुनौतियों पर विजय पाने के लिए अंतर्राष्ट्रीय संस्थाओं से साझेदारी भी की गयी है| दीर्घकालीन लाभों को देखते हुए मुख्य न्यायालयों में उच्च तकनीक वाली रिकार्डिंग प्रणाली लगाया जाना तुलनात्मक रूप में वहनीय हो सकता है| किसी भी सूरत में  समस्त विकासशील या संघर्षरत देशों में राजनैतिक इछाशक्ति, आधारभूत ढांचा और या साझी संस्थाओं के साथ नवीन प्रणाली स्थापित करने के संबंधों का अभाव है| वर्तमान में युद्ध–जर्जरित लाइबेरिया में न्यायाधीश सुनवाई हेतु  बैठने के लिए स्थान तक पाना मुश्किल पा रहे हैं| ढांचे –विद्युत शक्ति सहित- को स्थिर करना भी एक समस्या है|

वितीय पहलू के अतिरिक्त न्यायालय अपने ऐतिहासिक परम्पराओं के कारण भी एक चुनौती का सामना कर सकते हैं| परंपरागत आपराधिक कानून मौखिक साक्ष्य और मौखिक रिकार्ड को उच्च प्राथमिकता देता है जबकि सिविल न्याय मौखिक रिकार्ड को कम महत्त्व देता है| गवाह न्यायाधीश के सामने साक्ष्य देते हैं (भारत में व्यवहार में न्यायाधीश की अनुपस्थिति में भी साक्ष्य चलता रहता है), और न्यायाधीश इसका सार  रजिस्ट्रार को देता है जोकि इसे टाइप करता है| पक्षकार/साक्षी को समय-समय पर इसे पुष्ट करने के लिए कहा जाता है कि क्या  यह सही है और पक्षकार को जहाँ कहीं वह उचित समझे दुरुस्त कराने के लिए प्रेरित किया जाता है| आडियो वीडियो प्रणाली से अवयस्कों और उन लोगों का भी परीक्षण संभव है जो मुख्य न्यायालय में सुनवाई में उपस्थित नहीं हो सकते हैं|

फ़्रांस में न्यायालय क्लर्क न्यायाधीश और पक्षकारों के मध्य विनिमय किये गए समस्त रिकार्ड का लेखाजोखा रखने के दयित्वधीन है| वहाँ कोई मौखिक रिकार्ड नहीं रखा जाता है |इस प्रकार फ़्रांसिसी सिविल मामलों में मौखिक परीक्षण का रिकार्ड रखने के बजाय परीक्षण कार्यवाही के सार पर बल दिया जाता है | आपरधिक मामलों में फ़्रांस में दृष्टिकोण थोडा भिन्न है| इन मामलों में न्यायाधीश ऑडियो वीडियो रिकार्ड की अपेक्षा कर सकता है | फ़्रांस में आपराधिक मामलों में ऑडियो वीडियो रिकार्डिंग स्वतः नहीं है अपितु न्यायाधीश के विवेक पर है| ऐसी रिकार्डिंग जो स्पष्टतया अनुमोदित नहीं हो मुख्य न्यायाधीश द्वारा 18000 यूरो से अन्यून दंडनीय है| ऐतिहासिक मामलों में ऑडियो वीडियो रिकार्डिंग संग्रहालय में भी संधारित की जाती हैं| उदाहराणार्थ  उक्रेन में मामले  के दोनों अथवा एक पक्षकार द्वारा आवेदन करने या न्यायाधीश द्वारा पहल करने के अतिरिक्त कार्यवाही की रिकार्डिंग नहीं की जाती है| परिणामस्वरूप अधिकांश कार्यवाही पुराने परंपरागत ढंग से स्टेनो, टाइप आदि द्वारा जारी रहती है| सामान्यतया न्यायाधीशों द्वारा भी इस नवीन प्रणाली का प्रतिरोध किया जाता है| जहाँ कहीं भी नए कानूनी प्रावधान मौखिक रिकार्डिंग के पक्ष में हैं न्यायाधीश परिवर्तन का विरोध करते हैं|
भारत में भी सिविल मामलों में यद्यपि गवाह  द्वरा बयान शपथ पत्र द्वारा वर्ष 1999 से ही अनुमत किया जा चुके हैं किन्तु अभी भी गवाहों को बयान के लिए कठघरे में बुलवाने की परमपरा जारी है| मार्क्स ज़िमर के अनुसार सिविल न्यायाधीश ऐसी पारदर्शिता से भयभीत हैं जो  मौखिक परीक्षण रिकार्डिंग से उद्भूत होती हो और वे मामले के पक्षकारों को ऐसी पारदर्शिता से होने वाले  सामाजिक लाभों  को ही विवादित करते हैं| सिविल न्यायाधीश मानते हैं कि पारदर्शिता से अपीलों की संख्या और न्यायाधीशों के विरुद्ध अनाचार के व्यक्तिगत मामले – दोनों में वृद्धि होगी| यद्यपि आज तक यह स्पष्ट नहीं हो पाया है कि ये भय न्यायोचित हैं अथवा निर्मूल हैं| वर्तमान में कजाखस्तानी न्यायाधीश मौखिक साक्ष्यों की रिकार्डिंग की ओर बदलाव कर रहे  हैं| मौखिक साक्ष्यों की रिकार्डिंग की स्वीकार्यता में उनके मानसिक परिवर्तन और शुद्धता, पारदर्शिता, और अन्ततः सुरक्षा जो मौखिक रिकार्ड से न्यायाधीश एवं पक्षकार दोनों को उपलब्ध हो रही है| दक्षिण अफ्रीका में भी साक्ष्यों की ऑडियो रिकार्डिंग पर्याप्त समय से प्रचलन में है और इस उद्देश्य के लिए वहाँ अलग से स्टाफ की नियुक्ति की जाती है जो ऐसी प्रतिलिपि को सुरक्षित रखता है| न्यायालयों में प्रयोज्य उपकरणों के दक्ष उपयोग के लिए प्रारंभिक और लगातार प्रशिक्षण आवश्यक है| प्रत्येक प्रशिक्षण का वातावरण भिन्न होता है और समयांतराल से परिपक्व होता है| कई अफ्रीकी देशों यथा लाइबेरिया में सीमित न्यायिक सुविधाएँ हैं और न्यायालय जीर्णशीर्ण और टूटी फूटी इमारतों में संचालित हैं| इसलिए कानूनी कार्यवाहियाँ प्रायः न्यायाधीशों के कार्यालयों में ही संपन्न होती हैं |

जिन राष्ट्रों में न्यायालयों में काफी ज्यादा स्टाफ है उनमें मशीनीकरण से बेरोजगारी उत्पन्न होने का भय विकसित राष्ट्रों के बजाय ज्यादा है| न्यायालय स्टाफ को नवीन प्रक्रिया के योग्य बनाकर, स्वेच्छिक सेवा निवृति, अन्य विभागों में स्थानांतरण करके अथवा सेवा निवृतियों को ध्यान में रखकर चरणबद्ध मशीनीकरण कर इसका समाधान किया जा सकता है| स्वतंत्रता से पूर्व देशी राज्यों  के मध्य आयात पर जगात (आयात कर) लगता था | स्वंत्रता के उपरांत जगात  समाप्त कर स्टाफ का राज्यों द्वारा विलय कर लिया गया था| इसी प्रकार हाल ही में चुंगी समाप्त कर स्टाफ का समायोजन किया जाना एक अन्य उदाहरण है|  न्यायालयों में सारांशिक कार्यवाही के योग्य सिविल एवं आपरधिक मामलों का दायरा बढाकर भी त्वरित न्याय दिया जा सकता है| वैश्वीकरण के बहाव में कुछ वर्ष पूर्व कम्प्यूटरीकरण, दक्षता एवं लाभप्रदता में वृद्धि के लिए बैंकों और अन्य सार्वजानिक उपक्रमों में स्वेच्छिक सेवा निवृति और निष्कासन योजना को प्रोत्साहन दिया गया था| यद्यपि इस योजना का श्रम संघों द्वारा विरोध किया गया था किन्तु न्यायालयों एवं विधायिका दोनों द्वारा इसे उचित ठहराया गया था| अतः इसे अब न्यायालयों में लागू करने में भी कोई बाधा प्रतीत नहीं होती है|

कजाखिस्तान, बुल्गारिया, बोस्निया, हेर्ज़ेगोविना और अन्य बहुत से राज्यों में मशीनीकरण और आधुनिकीकरण के सकरात्मक परिणाम मिले हैं| इनमें समय की बचत ,पारदर्शिता एवं शुद्धता में वृद्धि, न्याय सदन की उन्नत प्रक्रियाएं, न्यायपालिका में विश्वास में वृद्धि ,अपील प्रक्रिया का अधिक दक्ष उपयोग  आदि प्रमुख हैं| दृश्य श्रव्य (ऑडियो-वीडियो) और उच्च तकनीकि न्यायालय रिकार्डिंग मशीनों से उच्च पारदर्शिता आती है क्योंकि वे सुनवाई का अच्छी तरह से सही और सम्पूर्ण रिकार्ड प्रस्तुत करती हैं| इससे से भी आगे कि परीक्षण न्यायालय का रिकार्ड अपीलीय न्यायालय द्वारा आसानी से अवलोकन किया जा सकता है| अधिकांश मामलों में रिकार्डिंग मशीनों द्वारा तैयार रिकार्ड असंपादित होता है, शब्दशः रिकार्ड जिसकी अपेक्षा करने पर मूल रूप में न्यायाधीश और पक्षकार दोनों द्वारा समीक्षा की जा सके| सही एवं शुद्ध रिकार्ड न्यायालय की प्रक्रिया में सुधार लाते हैं क्योंकि दावे के समस्त पक्षकार और न्यायाधीश सभी जानते हैं कि उनका व्यवहार रिकार्ड पर है |


दृश्य श्रव्य रिकार्डिंग से न्यायिक प्रक्रिया का संरक्षण होता है क्योंकि इससे सभी पक्षकारों  को वास्तविक कार्यवाही के प्रति जिम्मेदार ठहराये जाने के लिए इसे मोनिटरिंग उपकरण के रूप में प्रयोग किया जा सकता है| न्यायिक प्रक्रिया और प्रोटोकोल का सही सही एवं संकलित और पूर्ण चित्र प्रदान करने से यह प्रणाली नागरिकों को अपने अधिकारों व कर्तव्यों के प्रति शिक्षित करती है जिससे  अंततोगत्वा न्यायसदन में न्यायाधीश और पक्षकार दोनों के निष्पादन में सुधार आता है| यह ज्ञात होने पर कि इसे न्यायाधीश द्वारा विस्तार से देखा जा सकता है पक्षकार अधिक स्पष्ट और सही बयान देंगे| न्यायिक आचरण भी इससे मोनिटर किया जा सकता है और इससे अपील के आधारों की स्पष्टता और प्रमाणिकता बढती है |परिणामतः इससे निर्णय देने और मामला प्रस्तुत करने सम्बंधित प्रोटोकोल और व्यावसायिकता का निर्णयन में सही उपयोग करने को प्रोत्साहन मिलता है| न्यायाधीशों की  समयनिष्ठा एवं अनुशासनबद्धता के साथ-साथ न्यायिक प्रक्रिया में  दुरभिसंधियों पर भी इससे अंकुश लगता है

[justify]उच्च तकनीकि प्रणाली से समय का अधिक दक्षता पूर्वक उपयोग, पारदर्शिता में वृद्धि  और सुधरी हुई न्यायसदन की कार्यवाहियां सुलभ  होती हैं| साथ साथ इन लाभों से न्यायिक निकाय में जन विश्वास में भी वृद्धि होती है| उदाहारण के लिए इस रिकार्डिंग प्रणाली से न्यायपालिका द्वारा लोगों को रिकार्ड की गयी कार्यवाही की प्रतियाँ शीघ्र और सस्ती दर पर उपलब्ध करावाई  जा सकती हैं| इससे भी बढ़कर यह है कि ये गुणवता में सामान्य नकलों से अधिक सही और अच्छी होती हैं| सार रूप में उन्नत ग्राहक सेवा न्यायपालिका को अधिक सकारात्मक और विश्वसनीय बनाती है| जब न्यायालय द्वारा स्वचालित रिकार्ड वाले निर्णित मामले की अपील सुनवाई के लिए आती है तो अपील प्रक्रिया अधिक दक्ष होती है क्योंकि न्यायालय आसानी से परीक्षण न्यायालय के रिकार्ड तक पहुँच सकता है और परीक्षण न्यायालय के पूर्ण रूप से  सही रिकार्ड पर विश्वास कर सकता है| स्वचालित मशीनी रिकार्ड के संचयी सकारात्मक प्रभाव से अपील प्रक्रिया अधिक दक्ष बनती है| अंतिम किन्तु महत्वपूर्ण यह है कि पारदर्शिता एवं जिम्मेदारी  से कार्य करने पर कम ही मामलों में अपील की आवश्यकता पड़ती है| कजाखिस्तान परियोजना  पर एक रिपोर्ट के अनुसार मशीन से रिकार्ड किये गए मामलों की तुलना में न रिकार्ड किये गए मामलों में अपील की संख्या लगभग तीन गुणा अधिक  है|

इस  वचनबद्धता के लिए सावधानीपूर्वक आयोजन और लक्ष्य निर्धारण के साथ साथ विस्तृत रूप में लागू करने और प्रशिक्षण के दिशा निर्देश में परिवर्तित किये जाने की आवश्यकता है| भारत इन देशों के अनुभव से लाभान्वित हो सकता है| इन उपायों की दक्षता पर लगातार ध्यान रखने और मूल्यांकन करने की आवश्यकता की अनदेखी नहीं की जा सकती है| परिवर्तन प्रबंधन की नींव विशेष रूप से सशक्त राजनैतिक और वितीय  इछाशक्ति है| एक बार जब न्यायालय में स्वचालित रिकार्डिंग प्रणाली अपना ली जाय तो परियोजना में अप्रत्याशित चुनौतियों का सामना करना पड सकता है और कई लोगों को तदनुसार  दिशा बदलनी पड सकती है| दिशा में यह परिवर्तन खर्चीला, समय लेने वाला और हतोत्साही हो सकता है इसलिए परियोजना की सफलता परिवर्तन के प्रति ठोस राजनैतिक प्रतिबद्धता और सशक्त आर्थिक आधार पर निर्भर है| बहुत से मामलों में इस प्रकार के परिवर्तन के लिए न्यायिक मानसिकता में परिवर्तन की आवश्यकता चाहता है |

पुरानी  और नई प्रणाली के मध्य एक सहज एवं सामंजस्यपूर्ण परिवर्तन के लिए लक्ष्य सहित स्पष्ट योजना की आवश्यकता है| न्याय प्रबंधन संस्थान (अमेरिका) के अनुसार इस नवीन परिवर्तन के लिए निम्नांकित आठ क्षेत्रों में सुधार की आवश्यकता है :-

परिवर्तन के अधीन न्यायालय के लिए सशक्त नेतृत्व और परामर्श की आवश्यकता है| विभिन्न न्यायालयों के लिए लक्ष्य उनकी आवश्यकताओं और साधनों के अनुरूप होने चाहिए| न्यायालयों में रिकार्डिंग प्रणाली के लिए शुद्धता के मानदंड ,समयबद्धता,लागत  और रिकार्ड की उपयोगिता के स्पष्ट लक्ष्य निर्धारित किये जाने चाहिए| उदाहरण के लिए कई बार वीडियो रिकार्डिंग हाथ से लिखने से अधिक उपयोगी हो सकती है किन्तु कई बार यह विपरीत भी हो सकता है| परिवर्तन योजना में विद्यमान आधारभूत तकनीकि ढांचे का मूल्यांकन किया जाना चाहिए और यह देखा जाना चाहिए कि क्या यह नवीन प्रणाली के लिए सहायक हो सकता है| रिकार्ड का उत्पादन न्यायालय का मुख्य कार्य है और इसका अच्छा पर्यवेक्षण किया जाना चाहिए| कंप्यूटर आधारित लेखन प्रणाली में चुम्बकीय रिकार्डिंग प्रणाली कार्य करती है जोकि बोले गए शब्दों को आलेख में परिवर्तित कर देती है |


बेहतरीन परिवर्तनों के लिए समस्त ग्राहकों से सुझाव लेना महत्वपूर्ण है| एक अच्छा रिकार्ड अपील प्रक्रिया को आसान बना सकता है किन्तु बुरे रिकार्ड से मात्र समय नष्ट, कुंठा और न्याय प्रणाली में अविश्वास उत्पन्न  होता है| मेरीलैंड प्रान्त में न्यायालयों के पुराने स्टाफ को पहले प्रशिक्षित किया गया| न्यायालय कुशल स्टाफ को आकर्षक वेतन भत्ते प्रस्तावित कर सकता है| परिवर्तन हेतु विस्तृत योजना और ठोस लक्ष्य निर्धारण  के बाद प्राधिकारियों को चाहिए कि वे न्यायाधीशों, और अन्य समस्त जो रिकार्डिंग, संग्रहण, और रिकार्ड प्रदनागी  से जुड़े हैं के उपयोग के लिए विस्तृत परिचालन प्रक्रिया मनुएल तैयार करें जिसमें रोजमर्रा के सभी कार्यों एवं समस्याओं और उनके समाधानों का वर्णन हो| प्राधिकारियों को चाहिए कि नवीन  प्रणाली के निष्पादन पर निगरानी रखे और उसका मूल्यांकन करता रहे| इस प्रणाली की समय समय पर जांच की जानी चाहिए और यदि आवश्यक समझा जाय तो कुछ समय के लिए समानांतर प्रक्रिया भी अपनाई जा सकती है | स्वचालित रिकार्डिंग प्रणाली विश्व स्तर पर विकाशील एवं संघर्षरत राष्ट्रों सहित में लागू की जा रही है |

इंग्लैंड में भी संसद ने जनता और सांसदों को अपनी बात कहने के  सुगम, प्रभावी और पारदर्शी तरीके के लिए ई-पिटीशन प्रणाली की अनुशंसा की है| अमेरिका में भी  कागजी कार्यवाही कटौती अधिनियम पारित कर सूचना तक पहुँच का रास्ता सुगम बना दिया गया है|वहाँ न्यायालय का समस्त रिकार्ड इन्टरनेट पर उपलब्ध है| अमरीकी सरकार का मानना है कि समस्त रिकार्ड का कम्प्यूटरीकरण करने से सूचना के प्रकटन, संग्रहण, निर्माण, संधारण, विकेन्द्रीकरण, प्रसारण आदि के व्यय में भी कमी आयेगी| इससे निर्णय की गुणवता में सुधार और जिम्मेदारी आयेगी व सरकार और समाज में पारदर्शिता को बढ़ावा मिलेगा| प्रणाली को जनोन्मुखी बनाने के लिए जनता की भागीदारी ली जायेगी तथा सूचना तंत्र के विकास के लिए नीतियों, योजनाओं, नियमों, विनियमों, प्रक्रियाओं, और मार्गदर्शनों, और सरकार सूचनाओं के संग्रहण के पुनरीक्षणों के लिए जनता और इच्छुक एजेंसियों को टिपण्णी के लिए अर्थपूर्ण अवसर देगी| न्यायालयों द्वारा जनता  के लिए नागरिक चार्टर जारी करने की आवश्यकता की अनदेखी नहीं की जा सकती |

भारत में भी आडियो/वीडियो रिकार्डिंग प्रणाली के अभाव में काफी समय पूर्व से न्यायाधीशों  पर मनमानेपन के  आरोप लगते रहे हैं| सुप्रीम कोर्ट के न्यायाधीश श्री जे सी शाह पर आरोप लगाते हुए सी के दफ्तरी बनाम ओ पी गुप्ता (1971 ए आई आर 1132) में कहा गया कि यद्यपि दोनों न्यायाधीश जिन्होंने निर्णय दिया इसके लिए जिम्मेदार हैं किन्तु श्री जे सी शाह का दायित्व अधिक गंभीर है क्योंकि वे वरिष्ठ न्यायधीश हैं और प्रकरण के प्रभारी हैं| अन्य न्यायाधीश ने तो मात्र उनकी पंक्तियों का अनुसरण किया है| अपने कनिष्ठ के माध्यम से निर्णय सुनाने की उनकी चतुराई भी किसी को धोखा नहीं दे सकती| जहाँ लोक सभा में बोला गया प्रत्येक शब्द लिखा जाता है वहीँ सुप्रीम कोर्ट में पक्षकारों के तर्कों या न्यायाधीश के सम्प्रेक्षणों को न्यायाधीशों द्वारा नोट नहीं किया जाता है| यही कारण है कि न्यायाधीश शाह ने न्यायालय में इस विश्वास में इस प्रकार अवैध और बेईमानी पूर्वक मौखिक टिप्पणियां की कि ये टिप्पणियां रिकार्ड में दर्ज नहीं होंगी और कोई भी उसे तोड़ नहीं सकेगा|
हमारे माननीय विधि एवं न्यायमंत्री ने मार्च 2012 तक न्यायालयों के पूर्ण कम्प्यूटरीकरण का आश्वसन दिया था किन्तु कम्प्यूटरीकरण की मंथर गति एवं न्यायपालिका व उससे जुड़े लोगों की अनिच्छा व अरुचि, और प्रबल इछाशक्ति के अभाव में यह लक्ष्य दिवा स्वप्न ही दिखाई देता है| ई-कोर्टस परियोजना के बजट का भी पूरा उपयोग नहीं हो रहा है| भारत के सुप्रीम कोर्ट में 01.10.06 से यद्यपि ई-फाईलिंग प्रणाली प्राम्भ कर दी गयी है किन्तु इसका उपयोग अभी नगण्य है| कुल फाइल होने वाले मामलों का मात्र 00.10% ही ई-फाईलिंग के जरिये दाखिल किया  जाता है| इसमें से भी अधिकांश भाग बाहर दूर बैठे व्यक्तिशः याचियों द्वारा फाइल किया जाता है और उसमें न्यायालय के रजिस्ट्रारों द्वारा बिना नियमों के सन्दर्भ के अनुचित कमियां निकालकर उन्हें प्रारंभिक स्तर पर ही निरस्त कर दिया जाता है| व्यक्तिशः याचियों द्वारा दायर शेष  याचिकाओं में से अधिकांश को न्यायालय द्वारा “याची को सुना गया/मामले में सार नहीं है/निरस्त किया जाता है” जैसे परंपरागत संक्षिप्त आदेश पारित कर पटाक्षेप कर दिया जाता है जबकि स्वयं न्यायालय ने कई बार कहा है कि कारण के बिना निर्णय प्राण हीन हैं और न्यायालय को “निरस्त की” जैसा एक शब्द लिखकर सारांश रूप में याचिका निरस्त नहीं करनी चाहिए| यद्यपि मामला चाहे सारहीन हो किन्तु उसका सम्यक निपटान भी उठाये गए बिन्दुओं का जवाब देकर किया जा सकता है| सारहीन अपने आप में अस्पष्ट और कूटनीतिक शब्द है जिसका कोई निश्चित अभिप्राय नहीं  निकाला जा सकता| न ही सारहीन शब्द से यह ज्ञात हो पाता है कि सारपूर्ण होने के लिए और किन तत्वों या तथ्यों की आवश्यकता है|ऐसे शब्दों से युक्त आदेश न्यायिक आदेश कम और कूटनीतिक शब्दजाल की बाजीगरी अधिक परिलक्षित होते हैं| व्यक्तिशः फ़ाइल किये जाने वाले मामलों के नमूना सर्वेक्षण से भी इसी बात की पुष्टि होती है कि उन्हें सुनवाई का अर्थपूर्ण अवसर नहीं दिया जाता है बल्कि मात्र रस्म या औपचारिकता की ही पूर्ति की जाती है| यदि हमारी न्यायपालिका वास्तव में निष्ठावान है तो उसे रिकार्डिंग प्रणाली को शीघ्र ही लागू करने में पहल कर स्वयं को संदेह के दायरे से बाहर रखना चाहिए|वहीँ भारत में रिकार्डिंग प्रणाली के अभाव में सुब्रमनियन्न स्वामी के साथ एक अवमान याचिका की सुनवाई में उच्चतम न्यायालय में मुख्य न्यायाधीश ने स्वच्छन्द्ता पूर्वक अशोभनीय व गरिमाहीन व्यवहार किया|

[justify]संयुक्त राज्य अमेरिका के लुइसाना प्रान्त के  सुप्रीम कोर्ट के नियम 39 में प्रावधान है  कि सभी न्यायाधीश अपनी सम्पतियों का ब्यौरा प्रतिवर्ष न्यायिक प्रशासक कार्यालय में दाखिल करेंगे और निर्धारित समयावधि  के भीतर अथवा सही ब्यौरा प्रस्तुत नहीं करने पर अर्थदंड से दण्डित किया जायेगा| ये ब्यौरे नागरिकों द्वारा निरीक्षण के लिए खुले व सार्वजानिक दस्तावेज हैं| इस प्रसंग में उल्लेखनीय है कि अमेरिका में न्यायपालिका (विधायिका से) सर्वोच्च होते हुए भी अमेरिकी कानून वास्तव में सख्त है और वहाँ कानून का राज्य है अर्थात कानून सभी के लिए समान है| भारतीय परिस्थितियों को देखें तो यहाँ तो स्वतंत्रता के 64 वर्षों बाद भी किसी न्यायाधीश को तो दूर किसी सरकारी चपरासी  पर भी दण्ड लगाने की कल्पना तक नहीं की जा सकती| स्मरण रहे कि अमेरिका में उक्त ब्यौरा समय पर प्रस्तुत नहीं करने पर शांति न्यायाधीशों पर प्रतिदिन 50 डॉलर (2500 रुपये) और अन्य न्यायाधीशों पर प्रतिदिन 100 डॉलर (5000 रुपये) के अर्थदंड का प्रावधान है|
दिनांक 25.10.11 को लुइसाना सुप्रीम कोर्ट द्वारा निर्णित प्रकरण के तथ्य इस प्रकार हैं कि शान्ति  न्यायाधीश कुक ने उक्त नियमों के अनुसरण में अपना ब्यौरा निर्धारित समय सीमा दिनांक 09.07.2010  के स्थान पर दिनांक 18.11.10 को प्रस्तुत किया था| अभियुक्त न्यायाधीश कुक ने यह बचाव लिया कि इस दौरान उसकी माँ कैंसर से पीड़ित थीं और अंततः उनका देहावसान भी हो गया था अतः वह समय पर ब्यौरा प्रस्तुत नहीं कर सका| न्यायिक आयोग ने यह शिकायत प्रस्तुत की और अनुशंसा की कि न्यायाधीश कुक पर 132 दिन की चूक के लिए 6600 डॉलर अर्थदंड और 332.5 डॉलर खर्चा लगाया जाना चाहिए|

बाद में होफ्मन आदि के मामलों में  लुइसाना  सुप्रीम कोर्ट के निर्णय के मद्देनजर न्यायिक आयोग ने अपनी अनुशंसा को संशोधित करते हुए मात्र 200 डॉलर अर्थदंड के लिए संशोधित कर लिया| अब सुप्रीम कोर्ट के पास विचारणार्थ मुद्दा यह था कि क्या न्यायाधीश कुक ने जानबूझकर और साशय यह चूक की है| प्रकरण के तथ्यों और परिस्थितियों को ध्यान में रखते हुए सुप्रीम कोर्ट ने निष्कर्ष निकाला कि यद्यपि उक्त कृत्य जानबूझकर और साशय नहीं है अपितु उपेक्षापूर्वक किया गया है अतः 200 डॉलर के अर्थदण्ड  से दण्डित किया गया| ध्यान देने योग्य है कि सुप्रीम कोर्ट ने अभियुक्त की माँ की कैंसर पीड़ा और मृत्यु जैसी विकट परिस्थितियों के बावजूद उसे लापरवाही का दोषी मानते हुए एक न्यायाधीश को दण्डित किया है जबकि भारत में तो ऐसी परिस्थितयों में, और वह भी एक न्यायाधीश को दण्डित करना असंभव सा ही है| हमारे न्यायालयों में तो बनावटी बहानों से वकील आम आदमी को भी दण्ड से बचा लेते हैं यद्यपि न्यायाधीश यह सब जानते हैं फिर भी वे ऐसी छद्म प्रक्रिया में भागीदार बनने से कोई संकोच नहीं करते| इस प्रकार के अन्य प्रकरणों में न्यायाधीश मियर्स  को 500 डॉलर के अर्थदंड से, न्यायाधीश थ्रीट को 300 डॉलर के अर्थदंड से व न्यायाधीश ला ग्रेंग को 500 डॉलर के अर्थदंड से दण्डित किया गया| एक अन्य महत्वपूर्ण बात यह भी है कि इतने छोटे से कदाचार के मामले में अमेरिका में न्यायाधीशों को भी दण्डित कर दिया जाता है और दूसरी ओर महान भारत भूमि धन्य है जहां स्पष्ट भ्रष्टाचार में आकंठ डूबे न्यायधीशों को भी तारनहारों द्वारा अभयदान दे दिया जाता है| हमारे जनप्रतिनिधियों और न्यायाधीशों को चाहिए के न्यायपालिका के लिए उच्च मानकों वाली आचार संहिता का निर्माण कर उसे निष्ठा पूर्वक लागू करें|

भारत में विदेशी वस्तुओं और तकनीक को अपनाने वालों की अच्छी खासी तादाद है| विदेशी सामग्री को अपनाने के प्रति हर आम-ओ-खास में शर्म नहीं, बल्कि गर्व का सोच है| इस प्रकार से आजादी के समय में विदेशी कपड़ों की होली जलाने का भाव अब भारत में ध्वस्त हो चुका है| अब तो स्वदेशी की बात करने वाले और संत महात्मा भी आधुनिक सुविधा सम्पन्न जीवन शैली एवं वातानुकूलित संयन्त्रों में जीवन जीने के आदी हो चुके हैं| ऐसे में यह बात निर्विवाद रूप से कही जा सकती है कि आज वैश्‍विक अर्थव्यवस्था तथा अन्तरजाल (इंटरनैट) के युग में केवल भारत की विरासत और सोच को ही सर्वश्रेष्ठ  कहने वालों को अब अपनी परम्परागत सोच पर पुनिर्विचार करके खुले दिमाग और उदारता से सोचने की जरूरत है जिससे कि हम संसार के किसी भी कोने में अपनायी जाने वाली अच्छी बातों और नियमों को देश में खुशी-खुशी अपना सकें|
आज की कड़वी सच्चाई यह है कि केवल हम ही नहीं, बल्कि सारा संसार विकसित देशों का पिछलग्गू बना हुआ है| जिसका कारण विकसित देशों की जीवन शैली है, लेकिन हमारा मानना है कि किसी भी बात को आँख बन्द करके अपनाने की जरूरत नहीं है, बल्कि जो बात, जो सोच और जो विचार हमारे देश के लोगों के जीवन को बदलने वाली हो, उन्हें मानने, स्वीकरने और अपनाने में कोई आपत्ति या झिझक नहीं होनी चाहिये| जैसे कि हम कम्प्यूटर तकनीक को हर क्षेत्र में अपना रहे हैं, जिससे जीवन में क्रान्तिकारी बदलाव आये हैं| जो काम व्यक्तियों का बहुत बड़ा समूह सालों में भी नहीं कर पाता, उसी कार्य को कम्प्यूटर तकनीक के जरिये कुछ पलों में पूर्ण शुद्धता (एक्यूरेसी) से आसानी किया जा सकता है| ऐसे में हमारे जीवन से जुड़ी अन्य बातों को भी हमें सहजता और उदारता से अपनाने की जरूरत है|
इसी प्रसंग में संयुक्त राज्य अमेरिका की न्यायिक व्यवस्था के एक उदाहरण के जरिये भारत की न्यायिक व्यवस्था में बदलाव के लिये यहॉं एक विचार प्रस्तुत किया जा रहा है| जिस पर भारत के न्यायविदों, नीति नियन्ताओं और विधि-निर्माताओं को विचार करने की जरूरत है| इसके साथ-साथ आम लोगों को भी इस प्रकार के मामलों पर अपनी राय को अपने जनप्रतिनिधियों के जरिये संसद तक पहुँचाने की भी सख्त जरूरत है|
यहॉं सबसे पहले यह बतलाना जरूरी है कि अमेरिका में हर एक राज्य का संविधान और सुप्रीम कोर्ट अलग होता है| जो प्रत्येक राज्य की विशाल और स्थानीय सभी जरूरतों तथा आशाओं को सही अर्थों में पूर्ण करता है| प्रस्तुत मामले में अमेरिका के मिस्सिस्सिपी राज्य के सुप्रीम कोर्ट ने मिस्सिस्सिपी राज्य के न्यायिक निष्पादन आयोग बनाम जस्टिस टेरेसा ब्राउन डीयरमैन मामले में सुनाये गये निर्णय दिनांक 13.04.11 के कुछ तथ्य पाठकों के विचारार्थ प्रस्तुत हैं|
मिस्सिस्सिपी राज्य के न्यायिक निष्पादन आयोग ने वहॉं के सुप्रीम कोर्ट की जज डीयरमैन के विरुद्ध दिनांक 19.01.11 को औपचारिक शिकायत दर्ज करवाई| डीयरमैन पर आरोप लगाया  कि उन्होंने जजों के लिये लागू आचार संहिता के निम्न सिद्धांतों का उल्लंघन किया :-
(1) न्यायिक निष्ठा को संरक्षित करने के आचरण के उच्च मानकों को स्थापित करने, बनाये रखने और लागू करना|
(2) जज द्वारा हमेशा इस प्रकार कार्य करना कि उससे न्यायपालिका की निष्ठा व निष्पक्षता में जन विश्वास बढे|
(3) जज द्वारा अपने पद की साख को अन्य व्यक्ति के हित साधन के लिए उपयोग में नहीं लाना|
(4) जज द्वारा कानून का विश्‍वासपूर्वक पालना करना और व्यक्तिगत हितों के लिए कार्य करने से दूर रहना|
उपरोक्त सिद्धान्तों का उल्लंघन करके वहॉं के एक कोर्ट की जज डीयरमैन ने प्रथम न्यायिक फ्लोरिडा जिला सर्किट न्यायालय के जज लिंडा एल नोबल्स को दिनांक 05.11.10 को एक टेलीफोन किया और अपने एक पुराने मित्र के लिए सिफारिश करके उसे जमानत पर छोड़ने के लिये संदेश छोड़ा| यद्यपि उक्त फोन संदेश से पूर्व ही मामले की सुनवाई हो चुकी थी, जिससे जिला कोर्ट के निर्णय पर संदेश का कोई प्रभाव नहीं पड़ा, लेकिन जस्टिस डीयरमैन के विरुद्ध आरोप लागाये गये, जिन्हें स्वयं डीयरमैन ने स्वीकार कर लिया| डीयरमैन का आचरण मिस्सिस्सिपी राज्य के संविधान की धारा 177 ए के अंतर्गत भी दंडनीय होने के कारण और आचरण संहिता के उल्लंघन का आरोप लगने के बाद जस्टिस डीयरमैन स्वयं को सार्वजनिक रूप से प्रता़ड़ित किये जाने और 100 डॉलर (5000 रुपये) तक के खर्चे के दंडादेश को भुगतने के लिए भी स्वेच्छा से सहमत हो गयी| इसके बाद वहॉं के राज्य के सुप्रीम कोर्ट ने जस्टिस डीयरमैन को दोषी मानते हुए तीस दिन के लिए अवैतनिक निलंबन, सार्वजानिक प्रताड़ना और 100 डॉलर खर्चे का दण्ड  दिया|
इसके विपरीत भारत के सुप्रीम कोर्ट द्वारा उत्तर प्रदेश न्यायिक अधिकारी संघ (1994एससीसी 687) के मामले में सुनाये गये निर्णय में किसी भी जज के विरुद्ध मुख्य न्यायाधीश की अनुमति के बिना मामला दर्ज करने तक पर कानूनी प्रतिबन्ध लगा रखा है और भारत में तकरीबन सभी न्यायालयों द्वारा अमेरिका के उक्त मामले जैसे मामलों को तुच्छ मानते हुए कोई संज्ञान तक नहीं लिया जाता है| यह भारतीय न्याय व्यवस्था के लिये घोर चिंता और विचार का विषय है|

ROOT OUT THE COLONIAL RULE PERPETUATING IN INDIA

BENJAMIN FRANKLIN ADVISED AS UNDER FOR CONTINUANCE OF COLONIAL RULE BY EMPIRE AND THE ESTEEMED READERS MAY COMPARE THE SAME WITH PRESENT DAY INDIAN SCENARIO.

I address myself to all Ministers1 who have the management of extensive dominions [empires], which from their very greatness are become troublesome to govern because the multiplicity of their affairs leaves no Time for fiddling.

I.   DISTANCE OF COLONIES FROM BRITAIN
In the first place, gentlemen, you are to consider that a great Empire, like a great cake, is most easily diminished at the edges. Turn your attention, therefore, first to your remotest provinces, that as you get rid of them, the next may follow in order.
II.   RIGHTS & PRIVILEGES OF COLONISTS AS BRITISH SUBJECTS; LEGISLATION WITHOUT REPRESENTATION IN PARLIAMENT
[So] that the possibility of this separation may always exist, take special care the provinces are never incorporated with the mother country, that they do not enjoy the same common rights, the same privileges in commerce, and that they are governed by severer laws, all of your enacting, without allowing them any share in the choice of the legislators. By carefully making and preserving such distinctions, you will (to keep to my simile of the cake) act like a wise gingerbread baker who, to facilitate a division, cuts his dough half through in those places where, when baked, he would have it broken to pieces.

III.   CONTRIBUTION OF COLONIES TO ECONOMIC AND MILITARY POWER OF BRITISH EMPIRE
These remote provinces have perhaps been acquired, purchased, or conquered at the sole expense of the settlers or their ancestors without the aid of the mother country. If these should happen to increase her strength by their growing numbers ready to join in her wars, her commerce by their growing demand for her manufactures, or her naval power by greater employment for her ships and seamen, they may probably suppose some merit in this, and that it entitles them to some favor. You are therefore to forget it all or resent it as if they had done you Injury. If they happen to be zealous Whigs, friends of liberty, nurtured in revolution principles, remember all that to their prejudice and resolve to punish it: for such principles, after a revolution is thoroughly established, are of no more use; they are even odious and abominable.


IV.   COLONISTS’ MOTIVES & ALLEGIANCE TO BRITAIN; TREATMENT AS POTENTIAL REBELS
However peaceably your colonies have submitted to your government, shown their affection to your interests, and patiently borne their grievances, you are to suppose them always inclined to revolt and treat them accordingly. Quarter troops among them, who by their insolence may provoke the rising of mobs, and by their bullets and bayonets suppress them. By this means, like the husband who uses his wife ill from suspicion, you may in time convert your suspicions into realities.



V.   Quality And Character Of Appointed Governors And Judges
 Remote provinces must have Governors and Judges to represent the Royal Person and execute everywhere the delegated parts of his office and authority. You ministers know that much of the strength of government depends on the opinion of the people; and much of that opinion on the choice of rulers placed immediately over them. If you send them wise and good men for governors, who study the interest of the colonists and advance their prosperity, they will think their king wise and good and that he wishes the welfare of his subjects. If you send them learned and upright men for Judges, they will think him a lover of justice. This may attach your provinces more to his government. You are, therefore, to be careful who you recommend for those offices.  If you can find prodigals who have ruined their fortunes, broken gamesters or stock-jobbers, these may do well as Governors for they will probably be rapacious and provoke the people by their extortions. Wrangling Proctors and petty fogging Lawyers, too, are not amiss, for they will be forever disputing and quarrelling with their little parliaments. If withal, they should be ignorant, wrong-headed and insolent, so much the better. Attorneys Clerks and Newgate Solicitors will do for Chief Justices, especially if they hold their places during your pleasure. And all will contribute to impress those ideas of your government that are proper for a people you would wish to renounce it.

VI.   CRITICS OF CORRUPT AND UNJUST GOVERNORS AND JUDGES
To confirm these impressions and strike them deeper, whenever the injured come to the capital with complaints of mal-administration, oppression, or injustice, punish such suitors with long delay, enormous expense, and a final judgment in favor of the oppressor. This will have an admirable effect every way. The trouble of future complaints will be prevented, and Governors and Judges will be encouraged to further acts of oppression and injustice, and thence the people may become more disaffected and at length desperate.
VII.   CORRUPT AND DISTRUSTED GOVERNORS
When such Governors have crammed their coffers and made themselves so odious to the people that they can no longer remain among them with safety to their persons, recall and reward them with pensions. You may make them Baronets too, if that respectable order should not think fit to resent it. All will contribute to encourage new Governors in the same practices and make the supreme government detestable.
 
VIII.   TREATMENT OF COLONISTS’ CONTRIBUTIONS IN WARTIME AND PETITIONS FOR REDRESS OF GRIEVANCES
If when you are engaged in war, your colonies should vie in liberal aids of men and money against the common enemy upon your simple requisition, and give far beyond their abilities. Reflect that a penny taken from them by your power is more honorable to you than a pound presented by their benevolence. Despise, therefore, their voluntary grants, and resolve to harass them with novel taxes. They will probably complain to your parliaments that they are taxed by a body in which they have no representative, and that this is contrary to common right. They will petition for redress. Let the parliaments flout their claims, reject their petitions, refuse even to suffer the reading of them, and treat the petitioners with the utmost contempt. Nothing can have a better effect in producing the alienation proposed, for though many can forgive injuries, none ever forgave contempt.

IX. TAXATION WITHOUT CONSIDERATION OF COLONIES’ ECONOMIC BURDENS
In laying these taxes, never regard the heavy burdens those remote people already undergo in defending their own frontiers, supporting their own provincial governments, making new roads, building bridges, churches, and other public edifices, which in old countries have been done to your hands by your ancestors, but which occasion [cause] constant calls and demands on the purses of a new people. Forget the restraints you lay on their trade for your own benefit and the advantage a monopoly of this trade gives your exacting merchants. Think nothing of the wealth those merchants and your manufacturers acquire by the colony commerce, their increased ability thereby to pay taxes at home, their accumulating in the price of their commodities most of those taxes, and so levying them from their consuming customers. All this, and the employment and support of thousands of your poor by the colonists, you are entirely to forget. But remember to make your arbitrary tax more grievous to your provinces by public declarations importing that your power of taxing them has no limits, so that when you take from them without their consent one shilling in the pound, you have a clear right to the other nineteen. This will probably weaken every idea of security in their property and convince them that under such a government they have nothing they can call their own, which can scarce fail of producing the happiest consequences!

IX.   REMOVAL OF COLONISTS’ RIGHTS AND PRIVILEGES
Possibly, indeed, some of them might still comfort themselves and say, “Though we have no property, we have yet something left that is valuable; we have constitutional liberty both of person and of conscience. This King, these Lords, and these Commons,3 who it seems are too remote from us to know us and feel for us, cannot take from us our Habeas Corpus right or our right of trial by a jury of our neighbors. They cannot deprive us of the exercise of our religion, alter our ecclesiastical constitutions, and compel us to be Papists [Roman Catholics] if they please, or Mahometans [Muslims].” To annihilate this comfort, begin by laws to perplex their commerce with infinite regulations, impossible to be remembered and observed. Ordain seizures of their property for every failure. Take away the trial of such property by jury, and give it to arbitrary Judges of your own appointing and of the lowest characters in the country, whose salaries and emoluments are to arise out of the duties or condemnations [of property], and whose appointments are during pleasure. Then let there be a formal declaration of both houses that opposition to your edicts is treason, and that persons suspected of treason in the provinces may, according to some obsolete law, be seized and sent to the metropolis of the empire for trial [London]; and pass an act that those there charged with certain other offenses shall be sent away in chains from their friends and country to be tried in the same manner for felony. Then erect a new Court of Inquisition among them, accompanied by an armed force, with instructions to transport all such suspected persons, to be ruined by the expense if they bring over evidences to prove their innocence, or be found guilty and hanged if they can’t afford it. And lest the people should think you cannot possibly go any farther, pass another solemn declaratory act that “King, Lords, and Commons had, hath, and of right ought to have, full power and authority to make statutes of sufficient force and validity to bind the unrepresented provinces IN ALL CASES WHATSOEVER.”4 This will include spiritual with temporal, and taken together must operate wonderfully to your purpose by convincing them that they are at present under a power something like that spoken of in the scriptures, which cannot only kill their bodies but damn their souls to all eternity by compelling them, if it pleases, to worship the Devil.

X.   QUALITY AND CHARACTER OF CUSTOMS OFFICIALS; THEIR SALARIES,SPECIAL PRIVILEGES, AND TREATMENT OF COLONISTS
 To make your taxes more odious and more likely to procure resistance, send from the capital a board of officers to superintend the collection, composed of the most indiscrete, ill-bred, and insolent you can find. Let these have large salaries out of the extorted revenue and live in open grating luxury upon the sweat and blood of the industrious, whom they are to worry continually with groundless and expensive prosecutions before the above-mentioned arbitrary revenue Judges, all at the cost of the party prosecuted, tho’ acquitted, because the King is to pay no costs. Let these men by your order be exempted from all the common taxes and burdens of the province, though they and their property are protected by its laws. If any revenue officers are suspected of the least tenderness for the people, discard them. If others are justly complained of, protect and reward them. If any of the under-officers behave so as to provoke the people to drub [criticize harshly] them, promote those to better offices: this will encourage others to procure for themselves such profitable drub-bings by multiplying and enlarging such provocations, and all will work towards the end you aim at.

XI.   USE OF TAXES RAISED FOR DEFENSE TO AUGMENT GOVERNORS’ SALARIES
Another way to make your tax odious is to misapply the produce of it. If it was originally appropriated for the defense of the provinces, the better support of government and the administration of justice where it may be necessary, then apply none of it to that defense, but bestow it where it is not necessary in augmented salaries or pensions to every Governor who has distinguished himself by his enmity to the people, and by calumniating them to their Sovereign. This will make them pay it more unwillingly and be more apt to quarrel with those that collect it and those that imposed it, who will quarrel again with them, and all shall contribute to your main purpose of making them weary of your government.

XII.   ESPECIALLY SALARIES OF GOVERNORS RESPECTED BY COLONISTS
If the people of any province have been accustomed to support their own Governors and Judges to satisfaction, you are to apprehend that such Governors and Judges may be thereby influenced to treat the people kindly and to do them justice. This is another reason for applying part of that revenue in larger salaries to such Governors and Judges, given, as their commissions are, during your pleasure only, forbidding them to take any salaries from their provinces, that thus the people may no longer hope any kindness from their Governors or (in Crown cases) any justice from their Judges. And as the money  thus misapplied in one province is extorted from all, probably all will resent the misapplication.

XIII.   TREATMENT OF COLONIAL ASSEMBLIES RESISTING IMPERIAL ORDERS
If the parliaments of your provinces should dare to claim rights or complain of your administration, order them to be harassed with repeated dissolutions. If the same men are continually returned by new elections, adjourn their meetings to some country village where they cannot be accommodated and there keep them during pleasure. For this, you know, is your PREROGATIVE, and an excellent one it is, as you may manage it to promote discontents among the people, diminish their respect, and increase their disaffection.

XIV.   TREATMENT OF FISHERMEN, MERCHANT SHIPPERS, AND COASTAL FARMERS BY CUSTOMS OFFICIALS IN SEARCH OF SMUGGLERS
 Convert the brave honest officers of your navy into pimping tide-waiters and colony officers of the customs. Let those who in time of war fought gallantly in defense of the commerce of their countrymen, in peace be taught to prey upon it. Let them learn to be corrupted by great and real smugglers; but (to show their diligence) scour with armed boats every bay, harbor, river, creek, cove or nook throughout the coast of your colonies. Stop and detain every coaster, every wood-boat, every fisherman, tumble their cargoes and even their ballast inside out and upside down, and if a penn’orth of pins is found unentered,6 let the whole be seized and confiscated. Thus shall the trade of your colonists suffer more from their friends in time of peace than it did from their enemies in war. Then let these boats’ crews land upon every farm in their way, rob the orchards, steal the pigs and poultry, and insult the inhabitants. If the injured and exasperated farmers, unable to procure other justice, should attack the aggressors, drub [beat] them and burn their boats, you are to call this high treason and rebellion, order fleets and armies into their country and threaten to carry all the offenders three thousand miles [to Britain] to be hanged, drawn and quartered. O! This will work admirably!

XV.   RESPONSE TO COMPLAINTS AND PETITIONS FOR REDRESS OF GRIEVANCES   
 If you are told of discontents in your colonies, never believe that they are general or that you have given occasion [cause] for them. Therefore do not think of applying any remedy or of changing any offensive measure. Redress no grievance lest they should be encouraged to demand the redress of some other grievance. Grant no request that is just and reasonable lest they should make another that is unreasonable. Take all your informations of the state of the colonies from your Governors and Officers in enmity with them. Encourage and reward these leasing-makers; secrete [keep secret] their lying accusations lest they should be confuted [refuted; proven wrong]; but act upon them as the clearest evidence and believe nothing you hear from the friends of the people. Suppose all their complaints to be invented and promoted by a few factious demagogues whom, if you could catch and hang, all would be quiet. Catch and hang a few of them accordingly, and the blood of the Martyrs shall work miracles in favor of your purpose.

XVI.   RESPONSE TO OTHER NATIONS’ SUPPORT OF COLONIES’ RESISTANCE
If you see rival nations rejoicing at the prospect of your disunion with your provinces and endeavoring to promote it; if they translate, publish and applaud all the complaints of your discontented colonists, at the same time privately stimulating you to severer measures; let not that alarm or offend you. Why should it? Since you all mean the same thing.

XVII.   TAKEOVER OF FORTS, BUILT BY COLONISTS, FOR BRITISH USE AGAINST COLONISTS
If any colony should, at their own charge, erect a fortress to secure their port against the fleets of a foreign enemy, get your Governor to betray that fortress into your hands.7 Never think of paying what it cost the country for that would look, at least, like some regard for justice; but turn it into a citadel to awe the inhabitants and curb their commerce. If they should have lodged in such fortress the very arms they bought and used to aid you in your conquests, seize them all; it will provoke like ingratitude added to robbery. One admirable effect of these operations will be to discourage every other colony from erecting such defenses, and so your enemies may more easily invade them to the great disgrace of your government and, of course, the furtherance of your project.

XVIII.   USE OF BRITISH TROOPS IN FRONTIER REGIONS
Send armies into their country under pretense of protecting the inhabitants, but instead of garrisoning the forts on their frontiers with those troops to prevent incursions, demolish those forts and order the troops into the heart of the country [so] that the savages may be encouraged to attack the frontiers and that the troops may be protected by the inhabitants. This will seem to proceed from your ill will or your ignorance, and contribute farther to produce and strengthen an opinion among them that you are no longer fit to govern them.

XIX.   POWER & AUTONOMY OF CHIEF MILITARY OFFICER IN COLONIES
Lastly, invest the General of your army in the provinces with great and unconstitutional powers, and free him from the control of even your own Civil Governors. Let him have troops enough under his command, with all the fortresses in his possession, and who knows but (like some provincial Generals in the Roman empire, and encouraged by the universal discontent you have produced) he may take it into his head to set up for himself. If he should, and you have carefully practiced these few excellent rules of mine, take my word for it, all the provinces will immediately join him, and you will that day (if you have not done it sooner) get rid of the trouble of governing them and all the plagues attending their commerce and connection, from thenceforth and forever.

[justify]मिन्नेसोटा राज्य(अमेरिका) के सुप्रीम कोर्ट में न्यायिक मानक बोर्ड ने दिनांक 24.08.2010 को एक औपचारिक शिकायत दर्ज करवाई कि हेन्नेपिन काउंटी जिला न्यायालय की न्यायाधीश माननीय पैत्रासिया कर्र करासोव ने मिन्नेसोटा के संविधान और न्यायिक अचार संहिता का उल्लंघन किया है| मिन्नेसोटा के सुप्रीम कोर्ट द्वारा  नियुक्त एक त्रिसदस्यीय पैनल ने सुनवाई में पाया कि न्यायाधीश करासोव दिनांक 1जुलाई , 2009 से 30 सितम्बर, 2009 तक अपने न्यायिक जिले में निवास करने में विफल रही, और उसकी  निवास स्थिति की जांच के लिए गठित बोर्ड को सहयोग करने में, व ईमानदार तथा स्पष्टवादी होने में वह विफल रही| पैनल ने सिफारिश की कि न्यायाधीश करासोव को भर्त्सना और न्यायिक पद से 90 दिन के लिए बिना वेतन निलंबित किया जाये| उल्लंघन किये गए नियम इस प्रकार हैं :
नियम 1.1  एक न्यायाधीश न्यायिक आचार संहिता सहित कानून का पालन करेगा|
नियम 1.2   एक न्यायाधीश हमेशा इस प्रकार कार्य करेगा जिससे न्यायपालिका की स्वतंत्रता, निष्ठा, और निष्पक्षता में जन विश्वास बढे, और अनौचित्य व अनुचित प्रदर्शन से बचेगा | 
नियम 2.16 एक न्यायाधीश न्यायिक एवं वकालत सम्बंधित अनुशासनिक एजेंसियों के प्रति स्पष्टवादी और ईमानदार रहेगा तथा उन्हें सहयोग देगा|
मिन्नेसोटा के संविधान के अनुच्छेद 4 की धारा 4 के अनुसार जिला न्यायालय का प्रत्येक न्यायाधीश  अपने चयन और पद धारण करने के दौरान उस जिले का निवासी रहेगा|
बोर्ड द्वारा असहयोग के आरोप के सम्बन्ध में औपचारिक शिकायत थी कि न्यायाधीश करासोव ने बोर्ड को अपने क्रेडिट कार्ड के सम्बन्ध में सूचना प्राप्ति के लिए अधिकृति देने में विफल रही|
जनवरी 2011 में एक तीन सदस्यीय पेनल के समक्ष तीन दिन सुनवाई हुई | पेनल ने पाया कि न्यायाधीश करासोव ने जुलाई 2009 से जून 2010 के मध्य एक लिखित पट्टे के अनुसार अपने घर को किराये पर दे दिया|
प्रारम्भ में 29.05.2009 को न्यायिक मानक बोर्ड को एक सदस्य ने रिपोर्ट दी कि न्यायाधीश करासोव हेन्नेपिन काउंटी से बाहर रहती है| इस सदस्य ने बताया  कि इस सूचना का स्रोत एक प्रेक्टीस करने वाला वकील है जिसने नाम प्रकट न करने का आग्रह  किया है| उल्लेखनीय है कि भारत में गुमनाम या बेनामी शिकायतों पर कोई कार्यवाही ही नहीं की जाती है जबकि अमेरिका में गुमनाम शिकायत के आधार पर कार्यवाही कर एक जिला न्यायाधीश को छोटे से दुराचार के लिए भी गंभीर दंड से दण्डित कर दिया गया है|
पेनल ने यह भी निष्कर्ष निकाला कि न्यायाधीश करासोव ने यह पूछने पर कि क्या वह अपने न्यायिक जिले से  कभी बाहर रही हैं तो उसने असंगत जवाब दिया कि वह कभी भी बाहर नहीं रही लेकिन बाद में 3 अगस्त 2010 को अपने साक्षात्कार में उसने कहा कि वह 01.07.2009 से सितम्बर 2009 तक अस्थायी तौर पर बाहर  रही |
न्यायाधीश करासोव ने पैनल के निष्कर्षों के विरुद्ध यह कहते हुए अपील की कि बोर्ड स्पष्ट और संतोषजनक साक्ष्य से यह साबित करने में असफल रहा है कि उसने न्यायिक दुराचरण किया, और उसे कार्यवाही में अनियमितताओं व चूकों द्वारा कानून द्वारा स्थापित प्रक्रिया से मना किया गया है| बोर्ड और न्यायाधीश करासोव दोनों ने पैनल द्वारा सिफारिश किये गए दण्डों के विरुद्ध अपील की |
न्यायालय ने निष्कर्ष निकाला कि बोर्ड ने स्पष्ट और मानने योग्य साक्ष्य से साबित कर दिया है कि न्यायाधीश करासोव अपनी सेवाओं के दौरान अपने क्षेत्राधिकार वाले जिले में रहने में असफल रही और उसकी रिहायस के सम्बन्ध में बोर्ड द्वारा जांच में वह सहयोग देने और स्पष्टवादी व ईमानदार रहने में असफल रही और उसने आचरण के नियम 1.1, 1.2, और  2.16 तथा संविधान के अनुच्छेद 4 की धारा 4 का उल्लंघन किया है| न्यायालय ने आगे यह पाया कि न्यायाधीश करासोव का उचित प्रक्रिया का दावा गुणहीन है| अंत में, न्यायालय ने कहा कि हमारे विचार से छ माह के लिए बिना वेतन निलंबन व भर्त्सना इसके लिए उपयुक्त दंड है और तदनुसार दण्डित किया गया|

अमेरिका के मिसिसिपी प्रान्त के सुप्रीम कोर्ट ने न्यायाधीश लीघ एन डर्बी के विरुद्ध अपने निर्णय दिनांक 29.08.11 में पाया है कि न्यायाधीश डर्बी ने न्यायिक आचार संहिता के नियम 1, 2ए, और 3बी (2) का उल्लंघन किया है और परिणाम स्वरूप मिसिसिपी के संविधान की धारा 177ए के अंतर्गत कार्यवाही योग्य है| मामले के तथ्य इस प्रकार हैं कि दिनांक 13.08.09 को एल जे की एक पन्द्रह वर्षीय पुत्री टी को गिरफ्तार किया गया और उस पर आरोप लगाया गया कि उसने शांति भंग की है| 14.08.09 को इस  प्रकरण की सुनवाई में न्यायाधीश डर्बी ने उसे घर में बंदी बनाये रखे जाने का आदेश दिया| आगे सुनवाई में टी के मानसिक स्वास्थ्य का मुद्दा उठा तो न्यायाधीश डर्बी को ज्ञात हुआ कि टी ने स्वास्थ्य बीमा नहीं करवा रखा है| न्यायाधीश डर्बी ने मौखिक आदेश दिया कि टी की माता टी की ओर से स्वास्थ्य सहायता के लाभों के लिए आवेदन करे|
दिनांक 07.06.10  को टी की पुनः गिरफ़्तारी पर न्यायाधीश डर्बी ने दूसरी सुनवाई की| इस सुनवाई में न्यायाधीश को ज्ञात हुआ कि टी ने अभी तक स्वास्थ्य बीमा  नहीं करवाया है जबकि उसकी माँ को उसके नियोक्ता ने स्वास्थ्य बीमा का प्रस्ताव रखा था| न्यायाधीश डर्बी ने टी की माँ द्वारा स्वास्थ्य बीमा न करवाने पर भर्त्सना की और मौखिक रूप से माँ को स्वास्थ्य सहायता के लिए आवेदन करने को कहा| न्यायाधीश ने आगे यह भी मौखिक निर्देश दिया कि इस हेतु वह पार्कवूड  अस्पताल से संपर्क करे| दिनांक 08.06.10 को, न्यायाधीश के मौखिक निर्देशानुसार टी की माँ उसे पार्कवूड ले गयी | पार्कवूड  के स्टाफ ने निश्चय किया कि टी का इनडोर रोगी के तौर पर उपचार किया जाये किन्तु टी चूँकि बीमित नहीं थी अतः ऐसा उपचार प्रारम्भ नहीं किया जा सका| बाद में उसकी माँ ने स्वास्थ्य सहायता हेतु आवेदन किया वह भी मना कर दिया गया क्योंकि वह पात्रता की शर्तें पूरी नहीं करती थी|
यद्यपि टी को बाल स्वास्थ्य बीमा कार्यक्रम के लिए मंजूरी दी गयी और टी की माता से एक गारंटी समझौते को हस्ताक्षर करने के लिए कहा गया कि इस कार्यक्रम में यदि किसी खर्चे से मना कर दिया गया तो वह व्यक्तिगत जिम्मेदारी लेगी| रोजाना आने जाने के खर्चों व उससे जुडी परेशानी को देखते हुए टी की माता ने निष्कर्ष निकाला कि वह आउटडोर रोगी के रूप में यह खर्च वहन नहीं कर सकेगी|
न्यायाधीश डर्बी के न्यायालय के सलाहकार ने टी की माँ से यह कहा कि यदि उसने टी को पार्कवूड  में नहीं छोड़ा तो वह न्यायालय के अवमान की दोषी होगी| आगे उस सलाहकार ने (टी की) माँ को डर्बी के न्यायालय में अपरान्ह 2 बजे सुनवाई के लिए उपस्थित होने को कहा| न्यायाधीश डर्बी ने माँ को ताते काउंटी जेल में 3 बजे रिपोर्ट करने के लिए आदेश दिया ताकि उसे अभिरक्षा में लिया जा सके और आगामी आदेश तक उसे अभिरक्षा में रखा जा सके| तीन दिन बाद दिनांक 19.07.10 को न्यायाधीश डर्बी के समक्ष लाने के बाद माँ को छोड़ा गया|
मामले के तथ्यों से स्वस्पष्ट था कि (1) माँ पर जो आरोप लगाये गए उनके लिए कोई कथन दाखिल नहीं किये गए थे (2) माँ को सुनवाई के लिए कोई नोटिस नहीं दिया गया था (3) माँ को सुनवाई के लिए उपयुक्त समय नहीं दिया गया था और (4) माँ को उपयुक्त सलाहकार के लिए भी अवसर नहीं दिया गया था| फिर भी निष्कर्ष रूप में टी की माँ को पार्क वूड में टी के इलाज करवाने में असफल रहने पर अवमान का दोषी ठहराया गया जिसका कि कोई रिकोर्ड नहीं था|
दिनांक 18.12.10 को माँ की नागरिक शिकायत पर न्यायिक आयोग ने न्यायाधीश  डर्बी के विरुद्ध एक औपचारिक शिकायत दर्ज की| शिकायत में आरोप था कि न्यायाधीश डर्बी ने न्यायिक आचार संहिता के विभिन्न नियमों का उल्लंघन किया है जिसके लिए उसे संविधान की धारा 177ए के अंतर्गत दण्डित किया जाना चाहिए|
कार्यवाही के दौरान न्यायाधीश डर्बी भी इस बात से सहमत हो गयी कि आपराधिक अवमान के लिए टी की माँ को उसने उचित प्रक्रिया के अंतर्गत अधिकार को उसे अपनाने दिए बिना गलत रूप से दण्डित किया जिससे नियमों का उल्लन्घन हुआ है| न्यायाधीश इस बात पर भी सहमत थी कि उसका आचरण संविधान की धारा 177ए के अंतर्गत दंडनीय था क्योंकि ऐसा आचरण; दुराचरण व न्याय प्रशासन के हित के विपरीत था जो कि न्यायिक पद की बदनामी करता है| सार्वजानिक भर्त्सना, 500 डॉलर अर्थदंड  और 100 डॉलर खर्चे की संयुक्त रूप से सिफारिश की गयी|
सुप्रीम कोर्ट ने आगे यह भी पाया कि टी की माँ ने बिना लिखित आदेश के भी न्यायाधीश डर्बी के  निर्देशों की अनुपालना की थी|  सुप्रीम कोर्ट का यह भी मत था कि अप्रत्यक्ष या रचनात्मक आपराधिक अवमान की स्थिति में जब मामले में ट्रायल न्यायाधीश की सारभूत संलिप्सा हो तो अवमानकारी  की ट्रायल अन्य न्यायाधीश  द्वारा की जानी चाहिए| न्यायाधीश डर्बी ने इस मामले से दूर न रहकर अपनी अवमान शक्तियों का दुरूपयोग किया है| अवमान  की शक्तियों का यह दुरूपयोग न्याय-प्रशासन के हित के विपरीत है| तदनुसार न्यायाधीश डर्बी को सार्वजानिक भर्त्सना, 500 डॉलर जुर्माने और 100 डॉलर खर्चे से दण्डित किया गया|

उल्लेखनीय है की भारत में अमेरिका के समान इस प्रकार के न्यायिक उदाहरण मिलना दुर्लभ है जहाँ स्वयं न्यायाधीश को ही अवमान कानून के दुरुपयोग का दोषी पाया गया हो| यहाँ तो स्थिति यह है कि अत्यंत तुच्छ मामलों में भी नागरिकों को दण्डित कर नियंत्रणहीन  न्यायिक शक्तियों का एहसास करवा दिया  है और सुप्रीम कोर्ट तक भी इस सजा से मुक्ति दिया जाना असंभव नहीं तो कठिन अवश्य है| भारत में यह सब इसलिए घटित हो रहा है कि न्यायिक एजेंसी पर नियंत्रण के लिए अलग से कोई स्वतंत्र  निकाय का अभाव  है और अनियंत्रित न्यायपालिका स्वानुशासन की परिधि से बाहर स्वछन्द विचरण कर रही है| कोई भी वरिष्ठ न्यायाधीश सामान्यतया अपने कनिष्ठ भाई-बंधुओं के विरुद्ध कार्यवाही नहीं करना चाहता है क्योंकि स्वाभाविक रूप से आखिर वे सभी एकजुट हम-पेशेवर हैं|

भारत के न्यायालय अवमान अधिनियम की धारा 10 के परंतुक में कहा गया है कि कोई भी उच्च न्यायालय अपने अधीनस्थ न्यायालयों के संबंध में ऐसे अवमान का संज्ञान नहीं लेगा जो भारतीय दंड संहिता के अंतर्गत दंडनीय हैं| न्यायाधीशों के साथ अभद्र व्यवहार, गली गलोज, हाथापाई आदि ऐसे अपराध हैं जो स्वयं भारतीय दंड संहिता के अंतर्गत  दंडनीय हैं और उच्च न्यायालयों को ऐसे प्रकरणों में संज्ञान नहीं लेना चाहिए| किन्तु उच्च न्यायालय अपनी प्रतिष्ठा का प्रश्न समझकर ऐसे तुच्छ मामलों में भी कार्यवाही करते हैं|

भारत में कई उदाहरण यह गवाही देते हैं कि देश की न्यायपालिका स्वतंत्र एवं निष्पक्ष नहीं होकर स्वछन्द है| अभी हाल ही में माननीय कृषि मंत्री शरद पंवार के थप्पड़ मरने पर हरविन्द्र सिंह को पुलिस ने तत्काल गिरफ्तार कर लिया और उन पर कई अभियोग लगाकर मजिस्ट्रेट के सामने पेश किया गया| मजिस्ट्रेट ने भी हरविंदर सिंह को 14 दिन के लिए हिरासत में भेज दिया| देश की पुलिस एवं न्यायपालिका से यह यक्ष प्रश्न है कि क्या, संविधान के अनुच्छेद 14 की अनुपालना  में, वे एक सामान्य नागरिक के थप्पड़ मारने पर भी यही अभियोग लगाते, इतनी तत्परता दिखाते और इतनी ही अवधि के लिए हिरासत में भेज देते|

अमेरिका के मैंनि राज्य के सुप्रीम कोर्ट को वहाँ की न्यायिक जिम्मेदारी एवं निर्योग्यता समिति से दिनांक 20.05.11 को रिपोर्ट मिली कि जिला जज  लीमेन होम्स ने  न्यायिक आचरण की मैनी संहिता के कुछ सिद्धांतों का उल्लंघन किया है जिनमें समस्त न्यायिक मामलों के तुरंत निपटान की आवश्यकता बतायी गयी है| न्यायाधिपति लेवी ने पक्षकारों की सुनवाई की और दिनांक 04.10.11 को अपनी रिपोर्ट और सिफारिशें प्रस्तुत की| प्रकरण में दिनांक 08.11.11 को सार प्रस्तुत किया गया और दिनांक 01.12.11 को निर्णय घोषित किया गया| इतनी अल्प अवधि में और वह भी न्यायाधीश के मामले में निर्णय भारत में दिवा स्वप्न सा लगता है|

ऐसे मामलों में जजों को उपयुक्त दंड के निर्धारण के लिए न्यायालय कई पहलुओं पर विचार करते हैं जैसे कि न्यायाधीश का पूर्व इतिहास, वह पृष्ठभूमि जिसमें जज पर लगाये गए आरोपों के उल्लंघन की स्थिति निर्मित हुई, मुकदमे के पक्षकारों और जनता को हुई हानि, न्यायाधीश की उल्लंघन की स्वीकृति व पक्षकारों पर असर की आरोपित जज को समझ, उल्लंघन की गंभीरता, और न्यायाधीश के कार्य में जन विश्वास व आस्था की भावी संभावनाएं| उपलब्ध तथ्यों के अनुसार  न्यायाधीश होम्स वाशिंगटन जिला के 1989 से जिला न्यायाधीश हैं| वे अन्य संबद्ध जिलों के मामले भी सुनते हैं जहां के न्यायाधीश उन मामलों से दूर रहते हों| आरोपित जज के 22 वर्ष के सेवा काल में आचार संहिता के उल्लंघन का कोई मामला नहीं हुआ| प्रस्तुत मामले में आरोपित जज यह आरोप  है कि  वे लंबित मामलों का विधिवत रिकार्ड रखने के बजाय अपनी याददाश्त के आधार पर ही मामलों का रिकार्ड रखते हैं | जिससे वे मामलों का सही प्रबंधन करने में असफल रहे|
मामलों के कार्यभार के प्रभावी प्रबंधन के अभाव का स्पष्ट कारण गत वर्षों में मामलों की संख्या में भारी बढ़ोतरी था| अंशकालिक (23826 डॉलर वार्षिक वेतन पर) न्यायाधीश के रूप में नियुक्त होम्स को मदद करने के लिए प्रशासनिक संसाधनों में इस अनुपात में बढ़ोतरी नहीं हुई थी| स्मरणीय है कि अमेरिका में लगभग 18000 डॉलर वार्षिक तो अकुशल मजदूरों की न्यूनतम मजदूरी है और इससे थोडा ही अधिक न्यायाधीशों को दिया जाता है जबकि भारत में न्यूनतम मजदूरी लगभग 5500रुपये प्रति माह है और संविधान (अनुच्छेद 38(2)- राज्य विभिन्न व्यवसायों में लगे हुए समूहों के बीच भी प्रतिष्ठा, सुविधाओं और अवसरों की असमानता को समाप्त करने का प्रयास करेगा|) से विपरीत इससे 10 गुणा वेतन तो मजिस्ट्रेटों को दिया जा रहा है|

अपनी याददाश्त के आधार पर मामलों का प्रबंधन करना न्यायाधीश होम्स की एक पुरानी परंपरा थी जोकि प्रारम्भिक समय में तो प्रभावी हो सकती थी किन्तु कालांतर में कारभार बढ़ने के कारण बच्चों और परिवारों की सामयिक आवश्यकताओं की पूर्ति के लिए अब अप्रभावी थी| निर्धारित प्रक्रियानुसार होम्स को रजिस्टर रखना था जिसमें 30 दिन और 60 दिन से अधिक समय से बकाया मामलों की सूचि अलग से रखी जानी थी| किन्तु होम्स ने मात्र 30 दिन से अधिक समय से बकाया का ही रजिस्टर रखा और 60 दिन से अधिक बकाया मामलों पर ध्यान ही नहीं दिया |
सुनवाई के दौरान पक्षकारों और अन्य लोगों को विलम्ब से हुई कठिनाई के लिए न्यायाधीश होम्स ने खेद व्यक्त किया | न्यायालय ने होम्स के खेद को निष्ठापूर्ण माना |जांचकर्ता न्यायाधिपति लेवी ने एक माह के निलंबन की सिफारिश की किन्तु न्यायालय का विचार रहा कि होम्स ने उल्लंघनों को स्वीकार कर लिया है और भविष्य में ऐसी समस्या से दूर रहने के लिए योजना तैयार कर ली है, वह पूर्व में दण्डित नहीं है व वाशिंगटन जिले को 22 वर्ष से  निष्ठापूर्वक सेवाएँ दी हैं| अपने कर्तव्यों के प्रति होम्स की भावी प्रतिबद्धता को देखते हुए उनका एक माह के लिए निलंबन जनता व पक्षकारों  के हितों पर प्रतिकूल प्रभाव डालेगा और इससे जनहित सुरक्षित नहीं होगा|

सुप्रीम कोर्ट  ने आगे कहा कि हमें विश्वास है कि सार्वजनिक भर्त्सना और सुधारात्मक योजना से उसके व्यवहार में मौलिक परिवर्तन होगा, जनता की रक्षा होगी, और इससे इन उल्लंघनों की पुनरावृति नहीं होना सुनिश्चित होगा| अतः न्यायालय ने आदेश दिया की होम्स को इन उल्लंघनों के लिए सार्वजनिक प्रताडना दी जाय और होम्स तीस दिन से अधिक समय से बकाया मामलों के विषय में प्रति माह न्यायिक जिम्मेदारी समिति को रिपोर्ट देते रहेंगे| इधर भारत में तो न्यायधीशों को देवतुल्य माना जाता है उन्हें कोई बड़ा दंड देना तो दूर उनकी सार्वजनिक भर्त्सना तक नहीं की जा सकती|

The Supreme Court of India has prescribed in Siddharam Satlingappa Mhetre .Versus State of Maharashtra  Parameters  for arrest as :The antecedents of the applicant including the fact as to whether the accused has previously undergone imprisonment on conviction by a Court in respect of any cognizable offence;  The possibility of the applicant to flee from justice;. The possibility of the accused's likelihood to repeat similar or the other offences; Where the accusations have been made only with the object of injuring or humiliating the applicant by arresting him or her; Impact of grant of anticipatory bail particularly in cases of large magnitude affecting a very large number of people; The courts must evaluate the entire available material against the accused very carefully. The court must also clearly comprehend the exact role of the accused in the case. The cases in which accused is implicated with the help of sections 34 and 149 of the Indian Penal Code, the court should consider with even greater care and caution because over implication in the cases is a matter of common knowledge and concern; While considering the prayer for grant of anticipatory bail, a balance has to be struck between two factors namely, no prejudice should be caused to the free, fair and full investigation and there should be prevention of harassment, humiliation and unjustified detention of the accused;  The court to consider reasonable apprehension of tampering of the witness or apprehension of threat to the complainant;  Frivolity in prosecution should always be considered and it is only the element of genuineness that shall have to be considered in the matter of grant of bail and in the event of there being some doubt as to the genuineness of the prosecution, in the normal course of events, the accused is entitled to an order of bail. The arrest should be the last option and it should be restricted to those exceptional cases where arresting the accused is imperative in the facts and circumstances of that case. In Joginder Kumar vs State of U.P. and Others (1994 Cr.L.J. 1981) has also pleased to say, “Except in heinous offences, an ARREST MUST be avoided if a POLICE officer issues notice to person to attend the Station House and not to leave the station without permission would do.”
If the above law of Supreme Court be complied with by police the arrest of an accused will be required in rarest cases and no question of piling up bail application shall ever arise. Unfortunately the Police do arrest citizens with impunity and no court dares to condemn theses unruly police officers for violation of law declared by Apex Court of the Country, and release the arrestee without bail. The law of the Apex Court remains limited to an amusing exercise and open mockery by Police. The arrest and bail are though unnecessary in most of the cases but are life blood of the present Indian Judicial System functioning in an undemocratic manner. If the Courts are really governed by rule of law where the arrest is not found justified not only the arrestee should be freed u/s 59  of Cr P C but adequate compensation be granted to arrestee and the arresting police Officer should be prosecuted for “illegal Confinement”.

REDRAFTING OF INDIAN EVIDENCE ACT, 1872 FOR BETTER CONVICTION RATE AND CURBING CUSTODIAL VIOLENCE

The Governor General of India had enacted the above law to sub-serve the extensive interests of British Empire. The said law is not in tune with democratic values based on equality before law, and affords ample opportunities of misuse by the machinery enjoined upon duty to enforce law and order. Law Commission of India in it’s 152nd Report dated August 26, 1994 on Custodial Crimes (http://lawcommissionofindia.nic.in/101-169/Report152.pdf ) under Chapter – 2 -Head -Using force to compel statements leading to discovery has observed, “The root of this problem lies in a highly anomalous provision contained in the Evidence Act, namely, section 27. In the scheme of the Act, a confession made by a person in police custody is not admissible. By way of provision, section 27 lays down that if a person in the custody of a police officer makes a statement leading to the discovery of a fact, the same is admissible, whether or not it amounts to a confession. The fact that a statement can be rendered admissible, if it is represented to the trial court as a "discovery statement" and presented at the trial in the form of a confession marked as a discovery statement, a fact will known to every police officer, acts as a lever to the police officer to use unfair means to procure such a statement. The police knows that this is an easy method of circumventing the prohibitions based on practical wisdom, experience, of generations, and deep thinking.  It is an unpleasant thing to say, but it must be said, that SECTION 27 OF THE EVIDENCE ACT HAS BEEN PRODUCTIVE OF GREAT MISCHIEF, IN THE SENSE THAT IT GENERATES AN ITCH FOR EXTORTING A CONFESSION which, in its turn, leads to resort to subtle, disguised action in regard to the section. For the present, let us say that the section does need drastic surgery, if the cause of honest law enforcement is to be promoted.”

In D.K. Basu(http://judis.nic.in/supremecourt/imgs1.aspx?filename=14580) - the Supreme Court observed (see para 18):"Experience shows that worst violation of human rights take place during the course of investigation, when the police with a view to secure evidence or confession often resort to third-degree methods... The increasing incidence of torture and death in custody has assumed such alarming proportions that it is affecting the credibility of the rule of law and the administration of criminal justice system."   

It is very clear that Section 27 of the Act is causing great mischief and facilitates torture of an accused in the merciless hands of police and opens the doors for bargaining and corruption. Law Commission in it’s further Report No. 185 Dated 13.03.2003 has also taken an adverse view of the present form of 27 of the Act.  Virtually police draw unbridled powers from this section on the one hand, and there is no law to tackle police atrocities in India on the other.

The provision in the present form facilitates police to plant concocted stories and cooked evidence under the guise of this undemocratic law.  Many cases have surfaced where evidences were cooked, and totally innocent persons were trapped and convicted. The recent Case of Nachhatar Singh (   http://lobis.nic.in/phhc/showfile.php?sn=0 ) is a good example where Punjab Police planted all imaginary evidences- recovered blood stained arms, clothes etc in support of charges of murder and secured conviction. But the victim whose murder was charged upon and convicted the five accused later transpired out alive, and was present in the Court. Though the High Court awarded a compensation of Rs. One crore to the victims of unnecessary harassment and false imprisonment but that is neither amicable solution to tackle the menace nor any monetary compensation may be sufficient for unwarranted and unfair sufferings. One of the accused in case felt highly demoralized and committed suicide. The sane old dictum of the Indian judiciary is that even if thousands of culprits escape, not even a single innocent person should be punished but this section has proven against this very dictum.

The story of Police Engineering does not end here. Police has also planted false evidences in other cases too where the so called blood stains, in FSL reports, proved of animal blood or iron rusts. The accused persons are released after suffering a prolonged false imprisonment and nothing happens to these criminals in uniform patronized by power.  A valueable part of life of such illegally victimized persons is spoilt, financially ruined, families perturbed and even they have to face humiliation in society after release merely for the black law enacted in the present shape of section 27 of Indian Evidence Act, 1872.  Therefore this section should have been omitted as recommended by Law Commission. I regret to say that neither any review has been conducted nor any concrete steps have been taken by the esteemed Ministry since August 26, 1994.

The prosecution or police may advance a bad logic that this is an instrument in the hands of police to secure conviction of an offender but they should hinge upon innovative, contemporary and developed methods of investigation now. The Indian Evidence Act has been out dated and failed to meet the challenges of the day. The Act does not provide for modern evidentiary methods like those in electronic form etc. Australia has enacted new law ( http://www.legislation.act.gov.au/a/2011-12/current/pdf/2011-12.pdf ) on evidence which covers the modern challenges and the rate of conviction ( http://www.legco.gov.hk/yr09-10/english/sec/library/0910in19-e.pdf ) in Australia is 6.1% in  Magistrate Trial Cases and 8.2% in Session (Jury) Trial Cases while Law Commission of India in it’s Report No. 197 had expressed concern over a 2% conviction rate in India.  The Australian Evidence law has no provision like that Section 27 of Indian Evidence Act still the rate of conviction is more than triple in India. Therefore the fear of escaping of real culprits for want of section 27 is wholly unfounded. It is high time the total overhauling and redrafting of Evidence Law, taking beneficial advantages of Australian Law, including omission of section 27 be assigned top priority now.
